Summary[This summary does not form part of the decision. ]The Authority has not upheld a complaint that a segment on The AM Show, in which a booth designed to enable doctors to perform discrete testicle examinations was likened to a ‘confession booth’, breached the good taste and decency and discrimination and denigration standards. The Authority found that, in the context of the segment, the comparison was unlikely to undermine or violate widely shared community norms. It also did not reach the level of malice or nastiness necessary to denigrate a section of the community. The public health message in the broadcast was an important one and overall the Authority found that any potential for harm did not justify a restriction on the broadcaster’s right to freedom of expression....

The Authority has not upheld a complaint regarding comments made by the presenters of The Project about Taika Waititi and Chris Hemsworth. The presenters asked Kanoa Lloyd, who was at the Sydney premiere of Thor: Love and Thunder, about her experience interviewing the actors and ‘which one was hotter’ of the two. Lloyd said she embarrassed herself in front of the actors as she was talking about Hemsworth’s butt in the interview and that she preferred Hemsworth ‘just because I've seen the full Chris, and that's hotter to me’. The complainant considered the discussion was inappropriate ‘in our current #metoo society’. The Authority acknowledged societal issues surrounding sexual harassment and concerns regarding the normalisation of female-to-male sexual objectification. However, the comments in this instance did not go beyond audience expectations of The Project....

Mr Henry shared a story with Ms Wetzell and viewers about an ex-colleague of his who suffered from OCD, which took the form of a need to “count the pillars” while on his journey to work in the morning. It featured nude males manipulating their genitalia. [2] Fay Woodham complained to TV3 Network Services Ltd, the broadcaster, that the programme was offensive because "full frontal nudity" was unacceptable and breached standards relating to children’s viewing interests. B S G Lambert complained to the broadcaster, Television New Zealand Ltd, that the broadcast ridiculed and offended Christians and breached standards of good taste. TVNZ did not consider that the programme had breached standards of good taste. It maintained that the skit had legitimately lampooned religion. Dissatisfied with TVNZ’s decision, B S G Lambert referred the complaint to the Broadcasting Standards Authority under section 8(1)(a) of the Broadcasting Act 1989. Summary[This summary does not form part of the decision. ]During Talk with Sean Plunket, the CEO of the National Foundation for the Deaf called in to discuss captioning on television, and especially the perceived problem of the lack of captioning of broadcasts of the 2015 Rugby World Cup. Mr Plunket argued, ‘You can actually watch the rugby with the sound off, you can see – they’ve got big numbers on their backs – you can see what’s happening’ and asked, ‘Really is this such a problem? ’ After further discussion, he stated, ‘You do have a hearing problem because you’re not actually engaging in a conversation’. The Authority did not uphold a complaint that Mr Plunket’s comments amounted to bullying and denigrated the deaf community....

Summary Host Ritchie Watson told a caller to Radio Pacific to "take a swallow of the body of Christ and have a few gins with it" during his talkback programme broadcast on 23 October 1999 between 11. 00–12. 00pm. Terry Ryan complained to The RadioWorks Ltd, broadcaster of Radio Pacific, that the remarks, which were addressed to him, were a serious breach of decency and good taste. The RadioWorks advised that the remark was unacceptable and reported that the host had apologised and indicated that he had not realised that such comments would offend. It responded that the reference to "having a few gins" had been unacceptable, but did not find that it breached the good taste requirement. Dissatisfied with the station's response, Mr Ryan referred the complaint to the Broadcasting Standards Authority under s. 8(1)(a) of the Broadcasting Act 1989....

The Authority has not upheld a complaint about footage on a 1 News item of a person’s negative reaction after receiving a COVID-19 nasal swab. The Authority acknowledged the high public value and education in news reporting about COVID-19 testing and found the footage was unlikely to cause widespread undue offence. The Authority has not upheld a complaint that an interview between host Kim Hill and John Tamihere, Chief Executive of Te Whānau o Waipareira Trust and the Whānau Ora Commissioning Agency, on Radio New Zealand’s Morning Report breached broadcasting standards. It found the interview did not threaten current norms of good taste and decency, noting that the robust nature of the interview was in line with audience expectations of RNZ and Hill. It also found the balance standard was not breached on the basis that Tamihere was given sufficient time to express his views and, given other media coverage, viewers could reasonably be expected to be aware of other perspectives regarding how to best increase Māori vaccination rates.
