The Authority has not upheld a complaint that an item on Heather du Plessis-Allan Drive regarding MPs being infected with COVID-19 and mask-wearing breached multiple broadcasting standards. The Authority found the host’s comment that she would rather get COVID-19 than wear a mask all day was unlikely to seriously violate community standards of taste and decency. The comment did not relate to a recognised section of the community as contemplated by the discrimination and denigration standard or reach a threshold necessary to constitute discrimination or denigration. Nor did the broadcast ‘discuss’ a controversial issue of public importance as required for the balance standard to apply, and the comment at issue was an opinion to which the accuracy standard did not apply and which was unlikely to mislead the audience. Another item reported on a rally which took place in Nigeria's capital to mark the first anniversary of the abduction of some 200 school girls by the 'terrorist group Boko Haram'. The Authority did not uphold the complaint that the use of the terms 'Islamist terrorism' and 'terrorist' was selective and denigrated people who follow Islam. The references were accurate, did not carry any invective and were not exclusive to Islamic groups so the programme as a whole could not be considered to encourage discrimination against, or the denigration of, all people of the Islamic religion. A complaint that Malcolm Brenner was treated unfairly when interviewed for a segment on Dom, Meg and Randell about his previous sexual relationship with a dolphin has been upheld. MediaWorks interviewed Mr Brenner about his relationship with a dolphin but ultimately decided not to broadcast the interview in full. They did however broadcast a small segment of the interview in which one of the hosts called Mr Brenner ‘sick’ and stormed out of the interview. The Authority found that Mr Brenner was treated unfairly and was not adequately informed about the nature of his participation in the broadcast. In particular, he was misled into thinking a four minute version of the interview would be broadcast (rather than only the brief segment including the host’s reaction to him), when the final broadcast had already occurred....

Summary[This summary does not form part of the decision. ]During a sports news segment on Breakfast, the sports presenter was discussing American golfer Jordan Spieth’s victory at the British Open Championship. At the end of the segment the presenter remarked, ‘Yeah, they don’t have very good humour the British, do they? They probably didn’t get [Mr Spieth’s] speech. ’ A complaint was made that this comment was ‘racist and untrue’. The Authority did not uphold the complaint, finding the comment was not malicious and was unlikely to cause widespread offence, therefore any potential harm caused by the broadcast did not outweigh the broadcaster’s right to freedom of expression. The Authority has not upheld a complaint about a Seven Sharp segment on the cancellation of drag storytime events due to ‘nasty backlash online’ from Destiny Church and Family First. The complainant considered the segment discriminated against and denigrated Christians, men, and others with conservative values, was unbalanced, and was unfair towards Destiny Church, Family First, and those with ‘traditional family values’. The Authority found the standards did not apply to the broad group of people holding the particular values specified. It found the segment did not encourage the discrimination or denigration of Christians, and the phrase ‘don’t be a dick’ was not ‘anti-male’, as claimed by the complainant. It found the broadcast adequately presented significant perspectives in compliance with the balance standard....

The Authority has not upheld a complaint that a news item on Newshub Live at 6pm was insensitive and encouraged the denigration of Christians. The item covered the controversy around an Australian advertisement, which featured two Roman soldiers asking Jesus on the cross to consent to organ donation via an app. The Authority found that while the advertisement made light of the crucifixion, the news item itself was a balanced discussion of the controversy that did not contain any statements encouraging the denigration of, or discrimination against, Christians.   Not Upheld: Discrimination and Denigration...

The Authority has declined to determine two complaints under various standards, including discrimination and denigration, about an item on Seven Sharp on 28 September 2021. The item reported on employment issues relating to the COVID-19 vaccine. Following an interview with an employment lawyer, the presenters discussed a hypothetical dinner party where a guest turned out to be unvaccinated. The complainants were concerned about the treatment of people that were not vaccinated, who do not amount to a relevant section of society for the purposes of the discrimination and denigration standard. The remainder of the complaint reflected the complainants’ personal views and/or was unrelated to the broadcast. In all the circumstances (including scientific consensus around the safety of the COVID-19 Pfizer vaccine and the impact of the COVID-19 pandemic), the Authority considered it should not determine the complaints....
