The Authority has not upheld two complaints about an item on The Project. A presenter commented ‘I think happily we don’t have many Americans in New Zealand so we probably won’t end up in that situation’, in response to a question from another presenter, about whether New Zealanders would start demanding a right to bear arms as in the United States, in light of a recent knife attack. The complainants alleged these comments were discriminatory against Americans, and breached the discrimination and denigration standard. The Authority acknowledged the comments had the potential to cause offence, but found they did not meet the high threshold required to breach the standard and justify restricting the right to freedom of expression. The Authority has not upheld a complaint under the discrimination and denigration standard about a broadcast in which two co-hosts made fun of the third for giving his pet pig a name shared by ‘one of the most powerful figures in the Nazi Party’, and the three of them joked about distinguishing names associated with Hitler and the Nazis by spelling them differently. The Authority noted the comments may be considered distasteful, in that they trivialised the notoriety of Hitler and the Nazis, but found they did not meet the high threshold required to find a breach of the discrimination and denigration standard. Summary[This summary does not form part of the decision. ]The Authority did not uphold a complaint about the broadcast of the song ‘Hurricane’ by Bob Dylan, which contained the words: ‘And to the black folks he was just a crazy nigger’ [emphasis added], on Coast FM. The complainant found the use of the word in question to be ‘offensive, racist and unacceptable’. The Authority acknowledged the power of the word and that its use is highly contentious in New Zealand. The Authority acknowledged that its role is to reflect community standards and noted that its recent research, Language That May Offend in Broadcasting, showed a significant portion of the public find the use of this word in broadcasting to be unacceptable. The Authority declined to determine a complaint about this scheduling change, finding it raised matters of editorial discretion and personal preference rather than broadcasting standards. The Authority has not upheld a complaint about a comment made on Mike Hosking Breakfast referring to the use of te reo Māori names for government departments as the ‘Māorification of this country’. The Authority has declined to determine a complaint about a 1News broadcast discussing racial tensions arising from coalition government policies. The item mentioned a 1News Verian poll on whether the coalition government’s policies were increasing, decreasing, or making no real difference to racial tensions in Aotearoa New Zealand. The complainant alleged the broadcast, and the poll were ‘incredibly biased’ and that the broadcast breached the discrimination and denigration, accuracy, balance, and fairness standards. The Authority declined to determine the complaint on the basis it raised issues under the accuracy, balance, and fairness standards that could all be dismissed on grounds previously explained to the complainant; the broadcast could not be considered to encourage discrimination or denigration; and the complaint concerned issues of personal preference and had been adequately addressed in the broadcaster’s decision....

The Authority has not upheld a complaint that an item on 1 News concerning increased racism experienced by public figures in relation to co-governance issues breached the balance, accuracy and discrimination and denigration standards. The complainant alleged the association of opponents of co-governance with racist abuse was an attempt to paint all opponents as racist and stop debate. The Authority found the broadcast was accurate and the expert featured could reasonably be relied upon, and the balance standard was not applicable. While the complainant was concerned the broadcasts denigrated opponents of co-governance, this group is not a recognised section of society for the purposes of the standard. The Authority has not upheld a complaint about a segment of Gagaifo O Faiva that reported a Supreme Court of Samoa decision which convicted 11 men in relation to a 2023 kidnapping incident in Lefagaoali’i village, Samoa. The complaint alleged the broadcast discriminated against, denigrated, and was unfair to the 11 men sentenced. The Authority acknowledged the broadcast contributed to the distress felt by the complainant and the men’s families. However, having regard to factors including audience and cultural expectations of the presenter, the high public profile of the kidnapping, and public interest in the broadcast subject matter, the Authority found criticism of the 11 convicted was not unfair and any harm caused was not at a level to justify the Authority’s intervention. The discrimination and denigration standard did not apply, since the relevant comments were aimed at individuals as opposed to a protected section of the community....

The Authority has not upheld a complaint that ACT leader David Seymour MP was bullied and treated unfairly on Magic Afternoons with Sean Plunket. Mr Seymour called the show to present his perspective on comments made by Mr Plunket moments earlier about Mr Seymour’s motivation for sponsoring the End of Life Choice Bill. The Authority found that, while Mr Plunket’s interviewing style was robust and challenging, Mr Seymour was not treated unfairly given the nature of the programme, the fact that Mr Seymour initiated the conversation and expressed his views, and Mr Seymour’s position and his experience with the media. The Authority also found that the broadcast did not breach the balance standard as it did not amount to a discussion of a controversial issue of public importance, which is required for the balance standard to apply....

The Authority has not upheld a complaint alleging a segment on Police Ten 7 breached the discrimination and denigration standard. A man called a woman who had called the police a ‘nosey motherf***ing white c***’. The Authority found in the context of the long-running series, and the particular programme, this comment did not reach the threshold for a finding that it encouraged discrimination or denigration in breach of the standard. The Authority has declined to determine a complaint the use of the term ‘iTaukei’ to refer to indigenous Fijians breached the discrimination and denigration standard. The Authority has not upheld a complaint about an item on 1News about a spate of dog attacks in South Auckland. During the item’s introduction, an image of a black and white dog was depicted behind the presenter. The complainant said the image was of a Staffordshire Bull Terrier (‘Staffy) and its use may erroneously ‘encourage viewers to be fearful of Staffies, maybe even encouraging mistreatment’. The Authority found use of the image would not have caused viewers to fear or mistreat Staffies. The item did not suggest certain dog breeds are dangerous. Summary [This summary does not form part of the decision. ] During The AM Show, host Duncan Garner and then Newshub political editor Patrick Gower discussed various policies the new Labour Government was considering implementing, as well as legislation it planned to change or repeal. Discussing the ‘three strikes’ law, Mr Gower referred to one of the complainants, Mr Garrett, who was involved in introducing the law, and stated, ‘turned out that he had been stealing dead babies’ identities himself before he came into Parliament’. Mr Garner later clarified that it was ‘one dead baby’. The Authority upheld three complaints that the segment was inaccurate and unfair to Mr Garrett. While the broadcaster acknowledged the statement was inaccurate, the Authority found Mr Garner’s correction was dismissive and perfunctory, and insufficient to correct the error....
