The Authority has not upheld a complaint that the song Why Won’t You Give Me Your Love breached broadcasting standards. The complaint was that the song lyrics described an ‘intention to stalk, kidnap, imprison and rape’ and the song was inappropriate to broadcast in the afternoon. The Authority determined that the song’s satirical nature and upbeat style reduced the potential for the darker tone of the lyrics to cause harm. The song was within audience expectations for the eclectic music selection of the host programme, Matinee Idle and, taking into account the context of the broadcast, the lyrics did not undermine widely shared community standards and would not have unduly harmed child listeners. The Authority has not upheld a complaint about a broadcast of the song Long Gone by Six60, which included four instances of the line ‘Someday, when you give a fuck’, censored so the word ‘fuck’ was partially silenced. The Authority has not upheld a complaint about a comment referring to a sex act during an episode of New Zealand Today, which the host and interviewee both laughed at. The programme was classified 16-LSC, preceded by a full-screen warning and screened at 9pm. Given audience expectations for the programme, the classification, the warning and the scheduling, the Authority found the comment would not cause widespread undue offence and audiences were able to make their own viewing choices. The Authority considered a complaint about a promo for Taskmaster which was aired during the programme Breakfast (unclassified) at 7. 30am, and a promo for My Life is Murder which was aired during the programme The Chase (rated G) at 5. 35pm. The Authority did not uphold the complaint that these promos, which contained brief sexual references, breached the children’s interests standard. During the programme Sunday Mornings with The Resident Builder on Newstalk ZB, the host described how he used to make an implement to shoot fireworks as a young boy, ‘à la a good old fashioned sort of flintlock. ’ The complainant alleged these comments could have encouraged children listening to imitate the host’s actions and put themselves or others in danger, in breach of the children’s interests standard. Summary[This summary does not form part of the decision. ]An item on 1 News reported on the outbreak of a cattle disease on a farm in South Canterbury. The item featured an interview with a farmer who used the expression ‘for Christ’s sake’. The Authority did not uphold a complaint that this expression was offensive and unacceptable to broadcast during children’s normally accepted viewing times. The Authority found there was public interest and high value in hearing an authentic voice from a New Zealand farmer as part of the news report. The Authority also noted it has consistently found that variations of ‘Christ’ and ‘Jesus Christ’ are commonly used as exclamations, and in this case, the interviewed farmer used the phrase to express his frustration and strong support of the affected farm owner....

A complaint that a news item which included blurred clips of a politician in a strip club breached the children’s interests standard has not been upheld. The Authority found that the short news item contained brief and inexplicit clips from inside the strip club which were shown in the context of a news item about Australian politics. Generally audiences are aware of the need to exercise discretion during news programming to regulate their own and their children’s viewing. The Authority found that due to audience expectations of 1 News, which is an unclassified news and current affairs programme, the brevity of the clip and blurring applied, the public interest, and the focus of the item being on Pauline Hanson’s response to the resignation of a party candidate, the item would not cause undue harm to children. The Authority has not upheld a complaint that a promo for Love Triangle that aired during an episode of Treasure Island: Fans v Faves at around 8pm breached the offensive and disturbing content, and children’s interests standards. The Authority found that while the programme Love Triangle was rated 16-L, and Treasure Island: Fans v Faves was rated PG-L, the editing of the promo meant it was appropriate for the rating of the host programme and the timeslot. On this basis the promo would not have caused widespread undue offence, or harm to children in the audience justifying regulatory intervention. Summary[This summary does not form part of the decision. ]An item on Checkpoint reported on the final stages of a court case in Auckland, known as the ‘Dome Valley’ kidnapping, in which a young woman was kidnapped, beaten, sexually violated and left to die by a group of her former friends. The reporter outlined the events of the kidnapping and the item featured segments of the victim giving evidence (with her voice disguised) via audio-visual link from another room in the closed court. The reporter and the victim outlined her assault and injuries in some detail. No audience advisory was broadcast....

Summary[This summary does not form part of the decision. ] An item on 1 News reported on an alleged ‘mistake’ by the Ministry of Foreign Affairs and Trade (MFAT), which the reporter, Andrea Vance, said ‘cost the taxpayer a quarter of a million dollars’. The item referred to MFAT’s action in waiving the diplomatic immunity of an MFAT employee – the complainant – to allow child custody and matrimonial proceedings to be heard in an overseas court. According to Ms Vance, MFAT’s actions were disputed by the complainant’s ex-partner, resulting in MFAT issuing an apology and payment of ‘legal bills’ to both the complainant and the complainant’s ex-partner. The Authority upheld aspects of a complaint from the MFAT employee that the item was inaccurate, unbalanced and unfair....

The Authority has not upheld a complaint under several standards in relation to a segment on The Project. In the broadcast, comedian Justine Smith joked about throwing a half-eaten apple at anti-abortion protesters. The complainants alleged the segment was offensive, promoted violence and criminal activity, and discriminated against anti-abortion protesters. The Authority found that while the statements may have been offensive to some – in the context of the broadcast as a whole, taking into account audience expectations of the show, and the lack of any specific call to act – the alleged harm caused by the broadcast did not reach the thresholds required to restrict the broadcaster’s right to freedom of expression under any of the nominated standards. The Authority has not upheld a complaint that the action taken by NZME in response to a breach of the fairness standard during an episode of Heather du Plessis-Allan Drive was insufficient. The complaint related to an interview with a 16-year-old climate activist about the Schools Strike for Climate movement, and the group’s key demands. During the interview, the interviewee admitted she had recently travelled to Fiji, despite one of the group’s demands being a ban on ‘unnecessary air travel’. This resulted in the host hysterically laughing at, and teasing the interviewee for over a minute. The broadcaster conceded in light of the interviewee’s age and potential vulnerability, the segment breached the fairness standard. The Authority determined it too would have found a breach of the fairness standard, but in the circumstances considered the action taken by the broadcaster was sufficient to address the breach....

A promo for James Must-a-pic His Mum a Man aired during the programmes The Chase at 5. 10pm and 1News at 6. 50pm on TVNZ 1. The 14-second promo featured James Mustapic and Art Green sitting at opposite ends of a bathtub, with Mustapic asking Green for dating advice on behalf of his mum. The Authority did not uphold a complaint the promo breached the children’s interests standard due to nudity, noting only their chests and legs were visible, and there was no suggestion of sexual behaviour. The Authority has not upheld a complaint about an interview with Dame Jacinda Ardern on RNZ National, in which presenter Jesse Mulligan used the word ‘prick’ when asking Ardern about a past comment she made in Parliament. The complaint alleged the use of this language breached multiple standards. A promo for Comedy Gala aired during the programme Newshub Live at 6pm, stating ‘Prepare your pelvic floor, as you run the risk of wetting yourself. ’ The Authority did not uphold a complaint this statement breached the offensive and disturbing content, children’s interests and discrimination and denigration standards. It found the statement was a light-hearted joke directed at people generally, rather than just women as alleged by the complainant, and was suitable for a PG-rated environment. The Authority has upheld a complaint that promos for Quiet on Set: The Dark Side of Kids TV, Paper Dolls and The Playboy Murders broadcast during family movie Scoob! breached the offensive and disturbing content and children’s interests standards, and that action taken by the broadcaster in response to the complaint was insufficient. The Authority found that, viewed cumulatively, the promos went beyond expectations of the host programme and its PG-VL classification, and scheduling them during Scoob! meant the broadcaster did not enable child viewers to be protected from potentially unsuitable content. The Authority did not make any orders, however, finding publication of the decision was sufficient to publicly notify and remedy the breach and to provide guidance to the broadcaster and broadcasters generally.
