The Authority has not upheld complaints an interview on Saturday Morning between Kim Hill and Dr Kathleen Stock, a gender critical philosopher, breached broadcasting standards, including the discrimination and denigration, balance and accuracy standards. The broadcast discussed Dr Stock’s perspective on gender identity and her experiences resulting from voicing her perspective, having resigned from her position following a student campaign that accused her of transphobia. The Authority acknowledged the potential harm of the interview, but ultimately found the importance of freedom of expression outweighed any harm caused. The broadcast was clearly signalled as presenting Dr Stock’s perspective, to which she was entitled, and throughout the interview Hill challenged Dr Stock’s views, leaving the audience with a more balanced impression on the issue....

The Authority has not upheld a complaint the documentary Web of Chaos breached multiple standards. The complainant alleged the broadcast represented ‘women who like sewing and interior design as extremists’, which was allegedly ‘racist, sexist, anti-Christian and anti-women of Celtic origin’, lacked any balancing comment from women involved in the community, contained multiple inaccuracies, and was unfair. The Authority found the broadcast did not discriminate against or denigrate any of the nominated sections of the community and the broadcast was materially accurate. This was because the relevant comments were not claiming that all people participating in online craft communities were white nationalists, but rather these communities (like many other online communities) were exposing inadvertent users to extremist ideas. The Authority has not upheld a complaint an item on 1 News reporting on Immigration New Zealand’s decision to allow Kellie-Jay Keen-Minshull (also known as Posie Parker) into New Zealand breached the balance and fairness standards. The complainant was concerned with the broadcast’s description of Parker as ‘anti-trans’ rather than ‘pro-women’, and its link between Parker and people doing Nazi salutes at her events. The Authority found the item was balanced, referring to comments from both the Immigration Minister and Parker herself. It also considered Parker was treated fairly in the broadcast, noting the right to freedom of expression means broadcasters are free to use descriptors they consider appropriate, provided they do not breach broadcasting standards. The Authority has not upheld a complaint an interview on Midday Report with a transgender activist, who discussed whether Immigration New Zealand should allow Posie Parker to enter New Zealand, breached the accuracy, balance and fairness standards. The complainant considered: the host’s description of Parker as an ‘anti-trans activist,’ along with other comments made by the interviewee, were inaccurate; the host was biased; the interview was unbalanced as it did not include the perspective of a women’s rights activist; and that it was unfair to Parker and her supporters. The Authority did not uphold the concerns, finding the broadcast was materially accurate, was clearly approaching the topic from a particular perspective, and did not result in any unfairness. The Authority has not upheld a complaint regarding the question ‘How can anyone trust anything that you say? ’ put to Dr Ashley Bloomfield, Director-General of Health, following the positive tests of two women who were released from managed isolation on compassionate grounds. Dr Bloomfield’s answers to the question (which was posed twice) were shown on-air. Viewers would not have been left with an unduly negative impression of him. As a public health official he is reasonably subject to robust scrutiny, especially during a pandemic. The fairness standard was accordingly not breached and the remaining standards did not apply. The Authority did not uphold a complaint that a 1 News at Midday item about the United States presidential election lacked balance because it included clips of Joe Biden supporters and Biden’s campaign, but not Donald Trump supporters or the Trump campaign. The US election, while it could be considered a controversial issue of public importance for the purposes of the balance standard, was an issue that was widely covered by the media, including by TVNZ. Balance is not achieved by a ‘stopwatch’ meaning broadcasters are not required to give equal time to alternative viewpoints. The lack of emphasis on Trump supporters and the Trump campaign in this particular item would not have left viewers uninformed and did not breach the balance standard, given the widespread coverage available including of Mr Trump’s campaign and supporters. Summary[This summary does not form part of the decision. ]An item on 1 News reported on the humanitarian crisis in Damascus following disruption of water supplies, caused by fighting between the Syrian army and rebel forces. During the item, the reporter said, ‘The outage came after the government attacked rebels holding the city’s main water source’. The Authority did not uphold a complaint that this item was biased and misleading by allegedly attributing blame for the water outages to President Bashar al-Assad, rather than the rebel forces. In the context of a brief item focused on the humanitarian impact of the conflict, the statement made by the reporter was a reasonable description of what occurred, and the omission of further information or different sources would not have left viewers misled or uninformed about the events covered by the item....

The Authority has not upheld a complaint about comments made by Jack Tame during his morning show including the statement ‘Māori don’t just deserve special treatment, but are contractually guaranteed a form of special treatment under the Treaty’. The Authority found, in context, the comment amounted to analysis to which the accuracy standard does not apply. The comment was not the focus of the discussion, and an opinion-based segment such as this is not required to provide alternate perspectives under the balance standard. The Authority has declined to determine six complaints about various TVNZ broadcasts, under several standards, as the concerns related to the complainant’s personal preferences on what should be broadcast, issues raised had recently been dealt with and did not warrant further determination and/or the standards raised did not relate to the relevant complaint. The Authority has not upheld a complaint that a broadcast of Mediawatch, which contained commentary on a recently released Media Council decision concerning an article about puberty blockers, breached the balance, accuracy and fairness standards. The Authority found the programme was sufficiently balanced, noting its focus was on the Media Council’s decision (including its implications for journalists) and that it did not purport to be a balanced examination of the safety or reversibility of puberty blockers. It found alleged inaccuracies in the broadcast constituted comment, analysis or opinion to which the accuracy standard does not apply. Taking into account the Media Council’s role as a public-facing organisation, the Authority noted it can reasonably expect its decisions to be subject to public scrutiny, and found the critique of its decision did not result in unfairness. The Authority has not upheld two complaints that it was inaccurate and/or unbalanced for an item on 1News to describe land in central Auckland as being ‘gifted’ by Ngāti Whātua to the Crown in 1840. The Authority found it was not materially inaccurate to describe the land in this way in the context of an item focused on Ngāti Whātua’s call to change Auckland Anniversary Day. The Authority has not upheld a complaint about a 1News item discussing the results of a 1News Verian political poll. The item included analysis and commentary on the poll from 1News’ Political Editor, which the complainants considered was either ‘biased’, unbalanced, inaccurate or unfair to the coalition government. The Authority has not upheld a complaint that a segment on 7 Days was unfair to a singer who performed the New Zealand national anthem ahead of an All Blacks game in San Diego. The complainants said the broadcast was unfair to the performer and unbalanced, noting she was accused of ‘butchering’ the anthem and called ‘Dunedin’s most well-known murderer’. The Authority found the programme was not unfair, noting: viewers were unlikely to interpret the programme as suggesting the performer was an actual murderer or criminal; having chosen to perform at such an event, she could reasonably expect comment on her performance; viewers would not have been left with an unfairly negative impression of the performer; comments were directed at the performance rather than the performer personally; and that comedy and satire are valuable forms of expression. The Authority has not upheld a complaint that a brief Radio New Zealand (RNZ) News bulletin, reporting regarding violence in Amsterdam surrounding a football match between Ajax and Maccabi Tel Aviv, was inaccurate and unbalanced. The Authority found the brief, straightforward item did not amount to a ‘discussion’ of a controversial issue for the purposes of the balance standard; and listeners were unlikely to be misled by this single item given RNZ’s and other outlets’ earlier coverage of the events. By the time this item was broadcast, RNZ had already reported the information the complainant wished to be included in several other bulletins the previous evening and earlier the same day. The Authority has upheld two complaints concerning the accuracy of a brief 1News item on 15 November 2024 about heightened security in Paris following violence the previous week around a football match between Ajax and Maccabi Tel Aviv in Amsterdam. The item reported, ‘Thousands of police are on the streets of Paris over fears of antisemitic attacks…That's after 60 people were arrested in Amsterdam last week when supporters of a Tel Aviv football team were pursued and beaten by pro-Palestinian protesters. ’ TVNZ upheld the complaints under the accuracy standard on the basis the item ‘lacked the nuance’ of earlier reporting on the events, by emphasising the ‘antisemitic’ descriptor while omitting to mention the role of the Maccabi fans in the lead-up to the violence. The Authority agreed with this finding and further found the action taken by TVNZ was insufficient....

An episode of The Detail explored the Productivity Commission’s recommendation the Government review Aotearoa New Zealand’s regulatory framework around genetically modified organisms to ensure they remain fit for purpose. The complainant stated the broadcast was unbalanced and misleading as it, among other reasons, overemphasised the benefits of GMOs, did not critique the Commission, was inaccurate in several respects, and suggested issues with GMOs were largely ethical rather than scientific. The Authority did not uphold the complaint, finding the broadcast was balanced, particularly as it was focusing on a single issue. The Authority has not upheld a complaint an item on Newshub Live at 6pm, reporting on a draft report by the Ministry for Primary Industries | Manatū Ahu Matua proposing to ban many events in the sport of rodeo, was unbalanced and unfair. While the complainant was concerned the item lacked ‘pro‑rodeo’ perspectives, the Authority found the item made reasonable efforts to present significant points of view in the item, noting audiences can be expected to be aware of pro-rodeo perspectives as part of ongoing media coverage. The fairness standard was not breached in respect of the New Zealand Rodeo Cowboys Association (who were provided an opportunity to comment and were not otherwise treated unfairly) and did not apply in respect of other individuals or organisations named by the complainant given they were not referred to in the broadcast, as required by the standard.
