The majority of the Authority upheld (in part) a complaint about a segment on Marae discussing the bounds of the right to freedom of expression, in the wake of Posie Parker’s ‘Let Women Speak’ events. The complaint argued the segment was unbalanced, disproportionately favouring views of participants against the events, and inaccurate in multiple respects. The Authority found the segment adequately presented significant viewpoints through the inclusion of multiple guests, through the host’s questioning and in the introductory segment. The Authority considered most of the alleged inaccuracies were unlikely to have significantly affected viewers’ understanding of the broadcast as a whole. The majority found one of the comments in the broadcast (relating to the characterisation of Parker) was materially inaccurate and this issue created harm sufficient to justify a restriction on the right to freedom of expression. The Authority has not upheld a complaint about an item on Morning Report and a summary bulletin that discussed complaints about Kāinga Ora tenants forcing people to leave their homes. Kāinga Ora complained it was not given an opportunity to comment on one of two situations discussed during the broadcast, which led to the item being unbalanced, and was unfair to the agency. Noting the issue, and numerous similar cases, had been discussed over a number of months in RNZ reporting, the Authority found it was not required in the interests of either balance or fairness for Kāinga Ora to be given a specific opportunity to comment in relation to that particular case. In any event, the Housing Minister’s response, which referred to Kāinga Ora treating complaints seriously and its updated processes for dealing with complaints, was adequate to address the issues raised. The Authority has not upheld a complaint that an item on AM concerning the imminent arrival to Aotearoa New Zealand of Kellie-Jay Keen-Minshull, also known as Posie Parker, breached broadcasting standards. The complainant alleged the broadcast was unfair, inaccurate and denigrated Parker by describing her as ‘anti-trans’, that such a description ‘could well increase the likelihood of violent antisocial protests’ at her events, and that the item was also unbalanced. The Authority found that, given Parker’s views, the description ‘anti-trans activist’ was not unfair given its literal accuracy, and the brief item did not otherwise breach broadcasting standards. The Authority has not upheld a complaint that an item on RNZ’s 9am news bulletin about an electricity shortage in New Zealand breached multiple standards. The complaint focused on the broadcast’s allegedly inappropriate use of terms such as energy, fossil fuels, power and electricity and the omission of contextual information. In the context of the news bulletin, the Authority found RNZ’s audience was unlikely to be misled. Accordingly, the accuracy standard was not breached. The Authority has not upheld a complaint that a TVNZ news report concerning an Israeli military operation in the Occupied West Bank breached the balance and accuracy standards. The Authority found the balance standard was not breached as the requirement to present additional perspectives is reduced for programmes narrowly focused on one aspect of a larger complex matter, and the audience could reasonably be expected to be aware of significant context and viewpoints from other media coverage. While noting the balance standard is not directed at bias, the Authority also identified no bias in the language used in the broadcast. In a discussion concerning Prime Minister Christopher Luxon’s State of the Nation speech, the host stated to ACT Party Deputy Leader Brooke van Velden ‘You mentioned that, division was from the previous Government. I mean, come on, you look at the Treaty of Waitangi. You must be able to read the room in terms of how the nation is feeling towards that Bill by your party. ’ The complainant considered the host’s implication that this division was caused by ACT’s Treaty Principles Bill was inaccurate, unbalanced and unfair. The Authority has not upheld a complaint that a Newshub item reporting on changes to Reserve Bank rules requiring commercial banks to hold more capital in reserve was unbalanced. The item focussed on the potential effects of new capital requirements on the public, particularly borrowers. The Authority recognised that the item discussed a controversial issue of public importance and was satisfied that the item featured significant viewpoints on the particular issue discussed. The Authority has not upheld a complaint under the balance and accuracy standards about a 1News report on the start of a ceasefire deal between Hamas and Israel, and the first hostage/prisoner exchange as part of the deal. The complaint included claims the broadcast: failed to identify the West Bank as occupied; inaccurately cited how many were killed at the Nova festival and the identity of those attending the festival; inaccurately described the origin of the cars in the ‘car wall’; used ‘gratuitous adjectival framing to discredit Palestinian supporters’; and was overall unbalanced. The Authority has not upheld a complaint that a Newshub Live at 6pm report regarding water fluoridation and the Three Waters proposal breached the balance, accuracy and fairness standards. While the issue of how to improve Aotearoa New Zealand’s fluoridation is a controversial issue of public importance, the report included major perspectives on this issue, including alternatives such as central government orders, imposition of penalties and better data collection, as well as the Three Waters proposal. The Authority has not upheld a complaint that a brief Nine to Noon segment discussing the latest developments in a site investigation at the former Ivon Watkins-Dow (Dow) chemical plant in Paritūtū, New Plymouth lacked balance and accuracy. The Authority has not upheld a complaint that an interview on Afternoons with Jesse Mulligan concerning the Gene Technology Bill breached the balance standard. The host interviewed a professor of biological sciences regarding the progress of the Bill, and whether reducing regulation around genetic modification in Aotearoa New Zealand was a good idea. The complainant considered the segment lacked balance as it only provided a viewpoint in favour of the Bill and genetic modification. The Authority did not uphold the complaint, finding the interview was clearly signalled as approaching the issue from a particular perspective, referred to the existence of other perspectives, and the broadcaster had reported extensively on the issue, emphasising a range of different perspectives, within the period of current interest.
