The Authority has not upheld a complaint under the balance and accuracy standards about a 1News report on the start of a ceasefire deal between Hamas and Israel, and the first hostage/prisoner exchange as part of the deal. The complaint included claims the broadcast: failed to identify the West Bank as occupied; inaccurately cited how many were killed at the Nova festival and the identity of those attending the festival; inaccurately described the origin of the cars in the ‘car wall’; used ‘gratuitous adjectival framing to discredit Palestinian supporters’; and was overall unbalanced. Noting the challenges of verifying certain facts presented in the broadcast, the Authority did not uphold the complaints under the accuracy standard on the basis reasonable efforts had been made to ensure accuracy, or the relevant points were not materially inaccurate or misleading....

The Authority has upheld an accuracy complaint about a ThreeNews item reporting, ‘The Israeli military has carried out three strikes on Gaza. It comes after Hamas attacked Israeli troops in the south of the Strip. . . ’ An ITV reporter also stated in a pre-recorded update from Tel Aviv, ‘There were two problems today: a gun and rocket attack by Hamas on Israeli troops in southern Gaza… the Israelis chose to respond to those ceasefire violations. . . ’ The complaint was that viewers could only have concluded that ‘Hamas had breached the ceasefire and Israel had responded’, when the item should have reported that was ‘according to’ the Israel Defense Forces, and Hamas had already said it had ‘no connection’ to the alleged attack. The Authority agreed that the lack of attribution or acknowledgement that Hamas disputed Israel’s allegations constituted a materially misleading omission....

The Authority has upheld an accuracy complaint from John Minto on behalf of Palestine Solidarity Network Aotearoa about 1News’ reporting of violence that unfolded in Amsterdam surrounding a football match between the local team Ajax and Israel’s Maccabi Tel Aviv. The reporting comprised a pre-ad-break trailer reporting ‘antisemitic violence’, an introduction by the presenter which included a montage of ‘disturbing’ footage of violence described by Amsterdam’s mayor as ‘an explosion of antisemitism’, and a pre-recorded BBC item. The broadcaster upheld one aspect of the complaint, relating to mischaracterised footage used in the trailer and introduction, which was originally reported as showing Israeli fans being attacked, but later corrected by Reuters and other outlets to indicate it showed Israeli fans chasing and attacking one Dutch man....

The Authority has not upheld a complaint about a 1News item reporting a leaked recording showed National MPs were ‘keen to pinch’ a Labour Party policy to improve financial conditions for retirement village residents ahead of the next general election. The complaint was that the item was unbalanced as neither the Retirement Villages Association (RVA) nor the sector were approached for comment regarding claims made in the item. The Authority found the focus of the 1News item was clearly political, highlighting the Government’s desire to address residents’ concerns before the next election, rather than claiming to be a balanced discussion of how retirement villages operate or the merits of Labour’s policy. The Authority has not upheld a complaint under the balance and accuracy standards about two RNZ National news bulletins reporting on comments by Magma Healthcare Director Dr Simon Snook about the increase of abortions in 2024. In both broadcasts, Dr Snook attributed the increase in abortions to the increased availability of abortion services. The complainant alleged the broadcasts were unbalanced as they only featured Dr Snook’s comments and Snook’s description of abortions as ‘care’ was inaccurate. The Authority found the brief, straightforward items did not amount to ‘discussions’ of a ‘controversial issue of public importance’ for the purposes of the balance standard. The Authority has not upheld four complaints about a segment on The AM Show, which featured host Duncan Garner criticising parents who do not vaccinate their children, using terms such as ‘murderers’ and ‘bloody idiots’, and stating they should be ‘stripped of their right to spread their message and their viruses’. The Authority found that, taking into account audience expectations of Mr Garner and The AM Show, alongside other contextual factors, Mr Garner’s comments did not breach broadcasting standards. With regard to the balance standard, the Authority found that, while the anti-vaccination movement was a controversial issue of public importance, Mr Garner’s comments did not amount to a ‘discussion’ for the purposes of the standard, but reflected his own personal views on the issue....

The Authority1 has not upheld a complaint a discussion on an inquiry and proposed reforms to the Retirement Villages Act 2003 breached the accuracy, balance and fairness standards, due to the broadcaster failing to provide prior warning to the complainant of the inclusion of a further participant to the discussion, and for not providing sufficient time for the complainant to respond to the new participant’s analysis. The Authority found the complainant was provided with a fair opportunity to articulate his position and to respond to concerns raised by other participants; the alleged inaccuracies amounted to analysis, to which the accuracy standard does not apply, and the analysis was not materially misleading with respect to any facts referred to. The Authority has not upheld a complaint that a segment on AM, discussing the possible deregulation of GMOs, breached the balance and accuracy standards of the Code of Broadcasting Standards in New Zealand. The segment included two interviews with proponents for deregulation, which the complainant considered to be unbalanced, resulting in the audience being misled. The Authority did not uphold the balance complaint, finding the segment adequately acknowledged the existence of other perspectives, and that the topic had a long history of controversy, meaning the audience could reasonably be expected to be aware of different perspectives. The Authority has not upheld a complaint under the balance, accuracy and fairness standards about a broadcast of 1News discussing the United States’ decision to send more combat aircraft and war ships to the Middle East following the killing of Hamas political leader Ismail Haniyeh. The complainant argued the broadcast was unbalanced and biased towards American and Israeli interests by omitting to mention Haniyeh was the chief negotiator for Hamas in ceasefire negotiations relating to the ongoing Israel-Hamas conflict. The Authority found the broadcast was more of a report on recent events than a discussion of issues to which the balance standard might apply....

The Authority has not upheld four complaints that interviews on Q+A with Israeli and Palestinian representatives breached multiple broadcasting standards. On 21 April 2024, Jack Tame from Q+A interviewed Ran Yaakoby, the Israeli Ambassador to New Zealand. On 5 May 2024, Q+A interviewed Dr Izzat Salah Abdulhadi, head of the Palestinian Delegation to New Zealand. The complaints were made under several standards and included claims that: statements made by Yaakoby and Tame were inaccurate; Tame did not push back hard enough on Yaakoby; the interviews did not provide balance; the 21 April interview was unfair to Hamas, offensive, and discriminatory. The Authority did not uphold complaints under the accuracy standard on the basis: the relevant points concerned opinion to which the standard does not apply; reasonable efforts had been made to ensure accuracy; any harm was outweighed by freedom of expression; or the points were not materially inaccurate....

The Authority has not upheld a complaint about an RNZ news bulletin. The item briefly reported on the BBC’s apology concerning a live broadcast of music group Bob Vylan chanting ‘death, death to the IDF’, saying the apology described the chants as ‘antisemitic’. The complainant said the use of ‘antisemitic’ to describe the chants was unbalanced, inaccurate and unfair. Noting the statement was clearly attributed to the BBC and the context behind its statement was available to the audience, the Authority found the audience had the information needed to draw their own inferences and conclusions and would not be misled. The Authority has not upheld a complaint that a 1News item, reporting on developments in the Israel-Hamas conflict, breached the accuracy, balance and fairness standards. The item discussed an increasing number of countries formally recognising Palestine as a state due to Israel’s continuing military action in Gaza, and the possibility of New Zealand following suit. The complainant considered the report cast Israel in a negative light, contained numerous inaccuracies (largely in relation to its description of the geographical situation in the conflict zone), and omitted important information from an Israeli perspective. The Authority found no material inaccuracies or misleading omissions in the report. It found the balance standard was not breached as significant alternative perspectives on the issue were presented, including that of Israel; and the audience could reasonably be expected to be aware of significant viewpoints from other media coverage. The Authority has not upheld a complaint about a 1News item on Mother’s Day profiling a women’s duck shooting group in the Hawke’s Bay. The complaint alleged the tone of the item was disrespectful to wildlife including native wildlife, through irreverent comments such as describing duck shooting as ‘fun’ and good for ‘mental health’, which was ‘deeply offensive’; and it lacked balance and accuracy by not telling the other side of the story from the growing number of people who oppose duck shooting, or providing broader context about wildlife decline including among the four native species that are ‘allowed to be shot’. The Authority found the item was clearly framed as a light-hearted human-interest story rather than an in-depth exploration of a controversial issue requiring balancing viewpoints. Summary[This summary does not form part of the decision. ]Saturday Morning featured a segment in which presenter Kim Hill interviewed former MP and spokesperson for lobby group Hobson’s Pledge, Dr Don Brash, about the use of te reo Māori in New Zealand, specifically in RNZ broadcasting, without translation. The Authority did not uphold a complaint that the interview was unbalanced and unfair. The Authority found that, while Ms Hill asked Dr Brash challenging and critical questions, Dr Brash had a reasonable opportunity to put forward his competing point of view, and listeners would not have been left misinformed with regard to Dr Brash’s position. Given the level of public interest in the interview, Dr Brash’s position and his experience with the media, the Authority also found Ms Hill’s interview style did not result in Dr Brash being treated unfairly....

The Authority has not upheld a complaint about an item on The Detail that discussed Auckland Council efforts to monitor and improve the water quality and swimmability of Auckland beaches. The complaint was that the item failed to present alternative views, or test or challenge the views presented by Auckland Council representatives. The Authority noted the balance standard allows for significant viewpoints to be presented over time, and does not require every programme to canvass all significant views on a particular topic. In the context of the item, the Authority did not consider the likely impact of the visual content was to encourage illegal or antisocial behaviour. The Authority has declined to determine two complaints under various standards, including discrimination and denigration, about an item on Seven Sharp on 28 September 2021. The item reported on employment issues relating to the COVID-19 vaccine. Following an interview with an employment lawyer, the presenters discussed a hypothetical dinner party where a guest turned out to be unvaccinated. The complainants were concerned about the treatment of people that were not vaccinated, who do not amount to a relevant section of society for the purposes of the discrimination and denigration standard. The remainder of the complaint reflected the complainants’ personal views and/or was unrelated to the broadcast.
