The Authority has not upheld a complaint that a 1News broadcast about the greyhound racing industry’s perspective on their impending ban was unbalanced. The complainant alleged the broadcast was ‘one sided and seriously unbalanced’ by nearly exclusively presenting the industry’s perspective on the ban without including any viewpoints in support of the ban. The Authority found the broadcast was clearly introduced and presented as approaching the issue from the industry’s perspective and adequately included significant alternative viewpoints through comments by the 1News reporter, and Racing Minister Rt Hon Winston Peters. The audience could also reasonably be expected to be aware of significant viewpoints on greyhound racing through other, ongoing media coverage. Not Upheld: Balance...

The Authority has not upheld a complaint about an RNZ news bulletin. The item briefly reported on the BBC’s apology concerning a live broadcast of music group Bob Vylan chanting ‘death, death to the IDF’, saying the apology described the chants as ‘antisemitic’. The complainant said the use of ‘antisemitic’ to describe the chants was unbalanced, inaccurate and unfair. Noting the statement was clearly attributed to the BBC and the context behind its statement was available to the audience, the Authority found the audience had the information needed to draw their own inferences and conclusions and would not be misled. The Authority declined to determine a complaint about an interview with National Party MP and Leader of the Opposition Christopher Luxon. The complaint alleged the interview was disrespectful and biased, with the interviewer interrupting and expressing their own political views. The Authority has consistently not upheld complaints of a similar nature, and this complaint did not raise any specific issues which would distinguish it from the previous findings on the same issue. Summary[This summary does not form part of the decision. ]During an editorial segment on KPMG Early Edition, host Rachel Smalley discussed the standing down of British Labour MP Naz Shah after accusations of anti-Semitism. Ms Smalley went on to question why criticism of Israel is often viewed as criticism of the Jewish faith, referring to comments she made during a broadcast in 2014 which were critical of Israel and the ‘abuse’ she received in response. The Authority did not uphold a complaint alleging that Ms Smalley’s reference to her previous comments was misleading – partly because she did not refer to the Authority’s finding that one of her previous statements was inaccurate – and that the item was unbalanced....

The Authority did not uphold a complaint that a Newshub segment that discussed the potential rise of far-right ideology in New Zealand breached the balance and accuracy standards. The Authority found that the segment was balanced as it contained multiple points of view. The Authority also found that the presenter’s reference to the complainant as a ‘white supremacist’ was a statement of analysis and opinion to which the accuracy standard does not apply. An item on 1 News reported on Posie Parker entering Aotearoa New Zealand for speaking events, and explored the opposition she would face from transgender rights supporters. The Authority did not uphold a complaint the item was biased and unbalanced. While the broadcast did discuss a controversial issue of public importance for the purpose of the balance standard, the item clearly signalled it was approaching the issue from the perspective of transgender communities intending to attend the counter‑protest, sufficiently signalled the major perspectives on the issue, and the audience could reasonably be expected to be aware of alternative perspectives in any case. The Authority1 has not upheld a complaint a discussion on an inquiry and proposed reforms to the Retirement Villages Act 2003 breached the accuracy, balance and fairness standards, due to the broadcaster failing to provide prior warning to the complainant of the inclusion of a further participant to the discussion, and for not providing sufficient time for the complainant to respond to the new participant’s analysis. The Authority found the complainant was provided with a fair opportunity to articulate his position and to respond to concerns raised by other participants; the alleged inaccuracies amounted to analysis, to which the accuracy standard does not apply, and the analysis was not materially misleading with respect to any facts referred to. The Authority has not upheld a complaint concerning an item on 1News reporting on cuts to the public sector. The complainant considered the broadcast’s claim that public sector spending cuts were to help pay for the government’s tax cuts was inaccurate, unbalanced and was unfair to Minister of Finance Nicola Willis, as it fully attributed public sector funding reductions to paying for tax cuts. The Authority found no breach of the accuracy standard, noting the broadcast did not fully attribute public sector funding reductions to paying for tax cuts. It further found in a news story about the impact of the cuts, the broadcaster was not required to include reference to other reasons for better management of government funds, as well as other financial measures that would also help pay for tax cuts, as the complainant had submitted....

The Authority has not upheld a complaint that action taken by Television New Zealand Ltd was insufficient, after the broadcaster upheld a complaint under the accuracy standard about a statement in a 1News bulletin that ‘Israel would withdraw from Gaza’ as part of a peace proposal (when the proposal only contemplated withdrawal from densely populated areas). The Authority agreed with the broadcaster’s decision that the statement was materially inaccurate. However, it found TVNZ had complied with the accuracy standard requirement to correct material errors within a reasonable period by posting correct information on its website, and any potential harm caused by the broadcast was not of a level requiring any further action. The Authority has not upheld a complaint that a TVNZ news report concerning an Israeli military operation in the Occupied West Bank breached the balance and accuracy standards. The Authority found the balance standard was not breached as the requirement to present additional perspectives is reduced for programmes narrowly focused on one aspect of a larger complex matter, and the audience could reasonably be expected to be aware of significant context and viewpoints from other media coverage.  While noting the balance standard is not directed at bias, the Authority also identified no bias in the language used in the broadcast. The Authority has not upheld a complaint under the offensive and disturbing content, balance and accuracy standards about a segment of The Watermelon Report that said Jesus Christ was ‘a Palestinian’ and ‘a Palestinian refugee’. The Authority found the segment was unlikely to disproportionately offend or disturb the audience in the context of audience expectations of The Watermelon Report and the host. The broadcaster’s proactive broadcast of a clarification indicating the claim about Jesus was the presenter’s view and was ‘not universally supported’ addressed any concerns under the accuracy standard. The Authority has not upheld a complaint under the balance and accuracy standards about a 1News report on the start of a ceasefire deal between Hamas and Israel, and the first hostage/prisoner exchange as part of the deal. The complaint included claims the broadcast: failed to identify the West Bank as occupied; inaccurately cited how many were killed at the Nova festival and the identity of those attending the festival; inaccurately described the origin of the cars in the ‘car wall’; used ‘gratuitous adjectival framing to discredit Palestinian supporters’; and was overall unbalanced. Noting the challenges of verifying certain facts presented in the broadcast, the Authority did not uphold the complaints under the accuracy standard on the basis reasonable efforts had been made to ensure accuracy, or the relevant points were not materially inaccurate or misleading....

The Authority has declined to determine a complaint that 1News’ ANZAC Day bulletin, which included coverage of Māori soldiers, the 28th Māori Battalion and a pre-recorded story by 1News’ Māori Affairs Correspondent, breached the discrimination and denigration, balance and fairness standards. The Authority considered the relevant content appropriate to the context of the broadcast, which marked the first ANZAC Day without a surviving member of the 28th Māori Battalion. It also found the complaint reflected the complainant’s own personal preferences on a matter for the broadcaster’s editorial discretion and did not raise any issues of broadcasting standards that warranted determination. The Authority has not upheld a complaint about a 1News item reporting a leaked recording showed National MPs were ‘keen to pinch’ a Labour Party policy to improve financial conditions for retirement village residents ahead of the next general election. The complaint was that the item was unbalanced as neither the Retirement Villages Association (RVA) nor the sector were approached for comment regarding claims made in the item. The Authority found the focus of the 1News item was clearly political, highlighting the Government’s desire to address residents’ concerns before the next election, rather than claiming to be a balanced discussion of how retirement villages operate or the merits of Labour’s policy. The Authority has not upheld a complaint that a 1News item, reporting on developments in the Israel-Hamas conflict, breached the accuracy, balance and fairness standards. The item discussed an increasing number of countries formally recognising Palestine as a state due to Israel’s continuing military action in Gaza, and the possibility of New Zealand following suit. The complainant considered the report cast Israel in a negative light, contained numerous inaccuracies (largely in relation to its description of the geographical situation in the conflict zone), and omitted important information from an Israeli perspective. The Authority found no material inaccuracies or misleading omissions in the report. It found the balance standard was not breached as significant alternative perspectives on the issue were presented, including that of Israel; and the audience could reasonably be expected to be aware of significant viewpoints from other media coverage. The Authority has not upheld a complaint that a segment on 7 Days was unfair to a singer who performed the New Zealand national anthem ahead of an All Blacks game in San Diego. The complainants said the broadcast was unfair to the performer and unbalanced, noting she was accused of ‘butchering’ the anthem and called ‘Dunedin’s most well-known murderer’. The Authority found the programme was not unfair, noting: viewers were unlikely to interpret the programme as suggesting the performer was an actual murderer or criminal; having chosen to perform at such an event, she could reasonably expect comment on her performance; viewers would not have been left with an unfairly negative impression of the performer; comments were directed at the performance rather than the performer personally; and that comedy and satire are valuable forms of expression. The Authority has declined to determine a complaint about a 1News broadcast discussing racial tensions arising from coalition government policies. The item mentioned a 1News Verian poll on whether the coalition government’s policies were increasing, decreasing, or making no real difference to racial tensions in Aotearoa New Zealand. The complainant alleged the broadcast, and the poll were ‘incredibly biased’ and that the broadcast breached the discrimination and denigration, accuracy, balance, and fairness standards. The Authority declined to determine the complaint on the basis it raised issues under the accuracy, balance, and fairness standards that could all be dismissed on grounds previously explained to the complainant; the broadcast could not be considered to encourage discrimination or denigration; and the complaint concerned issues of personal preference and had been adequately addressed in the broadcaster’s decision....

The Authority has not upheld a complaint alleging a 1News item reporting on violence in Amsterdam in November 2024 surrounding the Ajax v Maccabi Tel Aviv football match, breached the balance standard. The Authority acknowledged the violence in Amsterdam appeared to be ‘controversial’, but was satisfied that to the extent the item could be seen as ‘discussing’ the alleged causes or instigators of the violence, the item adequately reported the information the complainant considered was missing.   Not Upheld: Balance...

The Authority has not upheld a complaint about a broadcast on Radio New Zealand National’s Nine to Noon marking one year since the 7 October 2023 Hamas-led attack on Israel. The broadcast included two interviews conducted by host Kathryn Ryan - one with BBC Middle East editor Sebastian Usher, and the other with Sally Stevenson, an emergency coordinator with Médecins Sans Frontières. The Authority found listeners were alerted to alternative significant viewpoints during Usher’s interview, and Stevenson’s interview was clearly signalled as being from Stevenson’s perspective. Additionally, the audience could reasonably be expected to be aware of significant context and viewpoints from other media coverage and, while noting the balance standard is not directed at bias, no material which indicated bias against Israel was identified....
