The Authority has declined to determine a complaint, under multiple standards, regarding two news items broadcast on Labour Day 2024: one about a protest against a proposed sewerage project and the other about commemoration of New Zealand’s Land Wars. Noting the complaint was not about content in the broadcasts but content the complainant wished to see included, the Authority found it related to editorial discretion and personal preference, which is not capable of being determined by a complaints procedure. The Authority has declined to determine a complaint about a 1News report on the recent rise in COVID-19 infections in New Zealand. The complainant alleged the programme was unbalanced for not mentioning a Cleveland Clinic study, which he alleged ‘shows a higher number of covid cases for each dose of the covid vaccine’, or other information about the effectiveness of the vaccine.  The Authority declined to determine the complaint as the broadcast did not discuss a controversial issue of public importance and the broadcaster’s decision adequately addressed the complaint. A Today FM news bulletin featured an item reporting on pro-trans demonstrations at an Auckland event where ‘anti-trans rights activist’ Posie Parker had been scheduled to speak. The complainant considered the item’s description of Parker as an ‘anti-trans rights activist’ rather than a ‘women’s rights campaigner’ was in breach of the fairness, balance, accuracy and discrimination and denigration broadcasting standards. The Authority found that, given Parker’s views, the description ‘anti-trans rights activist’ was not unfair given its literal accuracy. The balance standard did not apply as the item was a straightforward news report which did not ‘discuss’ the issue and, in any event, listeners were alerted to alternative viewpoints in the item. The Authority has not upheld a complaint under the balance and accuracy standards about two RNZ National news bulletins reporting on comments by Magma Healthcare Director Dr Simon Snook about the increase of abortions in 2024. In both broadcasts, Dr Snook attributed the increase in abortions to the increased availability of abortion services. The complainant alleged the broadcasts were unbalanced as they only featured Dr Snook’s comments and Snook’s description of abortions as ‘care’ was inaccurate. The Authority found the brief, straightforward items did not amount to ‘discussions’ of a ‘controversial issue of public importance’ for the purposes of the balance standard. Summary[This summary does not form part of the decision. ] The Authority has not upheld a complaint about an item on 1 News reporting on the separation of migrant families in the United States. The complaint was that references to President Donald Trump’s ‘immigration crackdown’ and ‘Trump’s policy’ of separating children from their parents were misleading, unbalanced and unfair as the relevant law pre-dated Trump’s presidency. The Authority concluded the broadcast did not breach the accuracy, balance or fairness standards, as the references reasonably reflected the Trump administration’s position regarding the enforcement of criminal prosecutions for illegal immigrants. The Authority emphasised the high level of public and political interest in the story and found that any limitation on the right to freedom of expression on this occasion would be unjustified....

The Authority declined to determine two complaints regarding broadcasts by Radio New Zealand. The first complaint related to a segment on the Five O’Clock Report which featured an interview with National Party MP Mark Mitchell. The second complaint related to a segment on the Morning Report featuring an interview with then leader of the Opposition, Simon Bridges. The complainant said the broadcast breached the promotion of illegal or antisocial behaviour, balance and accuracy standards on the basis the footage promoted gang activity/membership and misrepresented the current situation where gang patches and insignia are banned in public. The Authority1 has not upheld a complaint about a 1News item reporting on the Government’s proposed reform of the Retirement Villages Act 2003. The complainant alleged the segment was unbalanced for not explaining changes to payments in connection with the sale of vacated units will only be applied to new retirement village residents, and not current residents. The Authority found the broadcast provided significant perspectives regarding the proposed reform and did not purport to provide a comprehensive examination of the Government’s proposed changes.  In addition, the standard allows for balance to be achieved over time within the period of current interest, and the broadcaster had covered the issue of impacts on existing residents in reports the next morning. The Authority has not upheld a complaint a 1News segment on James Shaw’s decision to resign as co-leader of the Green Party breached the accuracy, balance, and fairness standards for including a statement from former Prime Minister Chris Hipkins that emissions had decreased for three years in a row. The Authority has not upheld a complaint, under the balance and accuracy standards, about an item on 1News reporting on a New Zealand scientist’s research trip to Greenland. The complainant alleged that a comment made by the host that ‘if all the ice in Greenland were to melt, the sea would rise by seven metres,’ was incorrect, as research shows the sea level rise to be occurring at a much lower rate. The Authority has not upheld a complaint about a 1News item on Hon Erica Stanford MP’s use of her personal email account for ministerial business. The item included analysis and commentary from 1News’ Political Editor, which the complainant considered was targeted against the Coalition Government and unbalanced. The Authority has not upheld two complaints that it was inaccurate and/or unbalanced for an item on 1News to describe land in central Auckland as being ‘gifted’ by Ngāti Whātua to the Crown in 1840. The Authority found it was not materially inaccurate to describe the land in this way in the context of an item focused on Ngāti Whātua’s call to change Auckland Anniversary Day. The item briefly described a ruling of the International Court of Justice in relation to Israel’s actions in Rafah, and an academic’s perspective on the potential reaction of the international community. The complainant argued other perspectives and information should have been included, the description of the ruling was inaccurate, and the various statements, omissions and inaccuracies contributed to breaches of multiple standards. The Authority found the brief item did not constitute a ‘discussion’, so the balance standard did not apply. The Authority has not upheld a complaint that an interview with a woman concerning her removal from an anti-co-governance meeting on Morning Report breached the balance, fairness and accuracy standards. The complainant alleged the broadcaster should have included balancing comment from, or interviewed Julian Batchelor (the speaker at the event concerned). The Authority has declined to determine a complaint that use of ‘Praise the Lorde’, in relation to New Zealand singer-songwriter Lorde, breached broadcasting standards. The Authority has not upheld a complaint from the New Zealand Forest Owners Association alleging an item about the sale of a sheep and beef station, Huiarua, to an overseas buyer breached the accuracy and balance standards. The Authority found no breach of the balance standard as the majority of the item was about the sale of a specific piece of land, and the period of interest is ongoing. The broadcaster also noted it would endeavour to include forestry perspectives in future items covering the issue. In context, it was not misleading for the item to not discuss the ‘special forestry pathway’ under the Overseas Investment Act, and the distinction between production forestry and carbon farming was not material to the item.
