The Authority1 has not upheld a complaint that interviews on The Detail discussing a ‘power imbalance’ between retirement village operators and residents breached the balance, accuracy and fairness standards. The complainant alleged the broadcast was unbalanced and unfair as it did not provide an alternative perspective from a retirement village operator or the industry, and the statement, ‘operators are just sitting on the weekly fee’, was inaccurate. The Authority found the broadcast was signalled as coming from a particular point of view and viewers were unlikely to expect a countering perspective in the broadcast. The Authority has not upheld a complaint that comments made by the hosts of Midweek Mediawatch concerning sexual violence during the October 7 attacks in Israel were inaccurate, unbalanced and unfair for downplaying or denying that sexual violence occurred. During an extended discussion concerning an interview on Q + A, and how the Israel-Hamas conflict is reported on generally, the hosts noted reporting of sexual violence on 7 October 2023 had been challenged by other outlets, and mentioned that the Q + A interview did not challenge these claims. The Authority found that the statements were more consistent with analysis, comment or opinion to which the accuracy standard did not apply. The Authority1 has not upheld a complaint a discussion on an inquiry and proposed reforms to the Retirement Villages Act 2003 breached the accuracy, balance and fairness standards, due to the broadcaster failing to provide prior warning to the complainant of the inclusion of a further participant to the discussion, and for not providing sufficient time for the complainant to respond to the new participant’s analysis. The Authority found the complainant was provided with a fair opportunity to articulate his position and to respond to concerns raised by other participants; the alleged inaccuracies amounted to analysis, to which the accuracy standard does not apply, and the analysis was not materially misleading with respect to any facts referred to. The Authority has declined to determine a complaint about comments made by the Political Editor on Newshub Live at 6pm, reporting on the first day of the new Parliament. Comments included that the Speech from the Throne sometimes sounded ‘like a National Party social media video’ and putting to Prime Minister Christopher Luxon ‘that’s National Party spin. ’ The complaint alleged this should have been identified as an opinion piece, and the Political Editor should be ‘unbiased’ and stick to news, not adding opinions. The Authority has not upheld a complaint about an item on Morning Report and a summary bulletin that discussed complaints about Kāinga Ora tenants forcing people to leave their homes. Kāinga Ora complained it was not given an opportunity to comment on one of two situations discussed during the broadcast, which led to the item being unbalanced, and was unfair to the agency. Noting the issue, and numerous similar cases, had been discussed over a number of months in RNZ reporting, the Authority found it was not required in the interests of either balance or fairness for Kāinga Ora to be given a specific opportunity to comment in relation to that particular case. The Authority has not upheld a complaint a discussion between the hosts of AM and an interview with Prime Minister Chris Hipkins breached multiple standards for including statements from the hosts questioning the usefulness and purpose of Government inquiries into various sectors. The Authority has not upheld a complaint that an interview on Saturday Morning with Baroness Dr Hilary Cass breached broadcasting standards. Dr Cass is the author of an independent review of NHS gender identity services for children and young people in England, whose findings contributed to the New Zealand Government’s decision to ban new prescriptions for puberty blockers to treat gender dysphoria or incongruence. The Authority acknowledged the complainant’s concerns about the harm that could result from the ban on puberty blockers in New Zealand, and that many New Zealand medical member associations have expressed strong concern about it. However, it found the interview was clearly signalled as presenting Dr Cass’s opinion on a controversial and unsettled debate (the long-term safety of puberty blockers in transgender healthcare) and did not breach the balance or accuracy standards....

The Authority has upheld a complaint about an item on Newshub Live at 6pm that discussed the alleged misuse of public funds for safety improvements at a greyhound racetrack. The complainant alleged the programme did not present a balanced view of the issue and misled the audience on key facts regarding what action was taken at the raceway. The Authority found the item was presented in a way that favoured the perspectives of those critical of the racing club’s actions, without giving reasonable opportunities to provide balance from the other side of the story. The segment was critical of the South Waikato District Council’s (SWDC) role in the authorisation of this new venue, and also one of the Councillors’ roles as both a Councillor and manager of one of the clubs involved in the creation of the proposed new venue. The following evening one of the programme hosts issued an on-air apology to the Councillor, clarifying inaccurate statements made about their involvement in the decision-making process. The Authority upheld SWDC’s complaint that the action taken by MediaWorks did not sufficiently remedy the harm caused by the breaches. The Authority has not upheld a complaint that a broadcast of Mediawatch, which contained commentary on a recently released Media Council decision concerning an article about puberty blockers, breached the balance, accuracy and fairness standards. The Authority found the programme was sufficiently balanced, noting its focus was on the Media Council’s decision (including its implications for journalists) and that it did not purport to be a balanced examination of the safety or reversibility of puberty blockers. The complaint alleged Tame was disrespectful and hostile to Luxon, and asked invasive personal questions, in breach of the fairness, balance and accuracy standards. The Authority did not consider Tame’s questions or comments went beyond a level of robust scrutiny or challenge that could reasonably be expected in an interview with the Leader of the Opposition on their party’s policies, particularly in the lead-up to a general election, and therefore the fairness standard was not breached. The Authority has not upheld a complaint a segment on Paddy Gower Has Issues breached the accuracy, balance and fairness standards of the Code of Broadcasting Standards in New Zealand. The segment included Gower stating he had ‘no issues’ with genetically modified corn, and that the effective ban on GE should be removed. The Authority has not upheld a complaint that a broadcast on Radio New Zealand National’s Saturday Morning breached the balance, accuracy, and fairness standards. The broadcast was an interview of a UNICEF spokesperson and humanitarian worker about her experience living and working in Lebanon amid the ongoing Israel-Hamas-Hezbollah conflict. The Authority found the broadcast was clearly signalled as being from the interviewee’s perspective and was not claiming nor intending to be a balanced examination of perspectives on the conflict.
