The Authority has not upheld a complaint about Sports Chat on RNZ’s Morning Report, during which the guest commentator briefly summarised violence surrounding the Maccabi Tel Aviv football match against local Dutch team Ajax in November in Amsterdam, including: ‘the Amsterdam Mayor has come out and said, look, criminals on scooters searched the city for Maccabi supporters in hit-and-run attacks. …said [they were] all antisemitic. ’ The complaint was that RNZ ‘severely distorted’ the context of the events to the point of inaccuracy; discriminated against and denigrated ‘the Amsterdam people who responded to Maccabi’s racist provocations’ and immigrants, by ‘choosing to represent this as antisemitism’; and lacked balance and fairness by excluding Amsterdam locals’ perspective. The Authority did not uphold the complaint, finding the brief summary of the Amsterdam mayor’s response was not materially misleading in the context of Sports Chat, and the remaining standards did not apply....

The Authority has not upheld a complaint that an interview on Afternoons with Jesse Mulligan concerning the Gene Technology Bill breached the balance standard. The host interviewed a professor of biological sciences regarding the progress of the Bill, and whether reducing regulation around genetic modification in Aotearoa New Zealand was a good idea. The complainant considered the segment lacked balance as it only provided a viewpoint in favour of the Bill and genetic modification. The Authority did not uphold the complaint, finding the interview was clearly signalled as approaching the issue from a particular perspective, referred to the existence of other perspectives, and the broadcaster had reported extensively on the issue, emphasising a range of different perspectives, within the period of current interest. The Authority has not upheld a complaint about a Paddy Gower Has Issues segment on the price of butter in Aotearoa New Zealand. The complaint alleged the broadcast breached the balance and accuracy standards because it suggested supermarkets were responsible for increased butter prices yet presented no evidence proving this. The Authority found the balance standard was not breached. Sky Free presented significant viewpoints, including that of Woolworths, and gave various supermarkets an opportunity to comment. Additionally, the issue of butter prices was raised in a humorous manner, and audiences could reasonably be expected to be aware of views expressed in other coverage. Under the accuracy standard, the Authority found viewers were also unlikely to be misled by this single item, in the context of the broadcast and given extensive media coverage of the subject. The Authority has not upheld a complaint that a segment on 1News about Oranga Tamariki-run bootcamps breached the balance standard. The complainant considered the 1News reporter’s attitude, questioning and body language evidenced a ‘left bias’ and ‘a fair representation of the story’ was not given. The Authority found the balance standard was not breached as the broadcast presented sufficient viewpoints and the audience could reasonably be expected to be aware of additional perspectives from other media coverage. The Authority has not upheld a complaint that comments made by a political panellist on Nine to Noon, including that National Party public meetings were ‘full of angry racists saying angry racist things’ breached broadcasting standards. While the Authority acknowledged the statement was inflammatory, it found the statements were hyperbole and political comment and opinion, and they were challenged immediately by another panellist – meaning listeners were unlikely to be misled, and given sufficient viewpoints to form their own opinions. The Authority has not upheld a complaint alleging an item on Morning Report misrepresented the Hawke’s Bay Regional Council’s views responding to iwi concerns about groundwater issues, including why local streams were drying up, and did not properly examine the complexity of the issues. The Authority found no breach of the balance standard as the item focused on one aspect of the issue and was clearly presented from the iwi’s perspective, and there is ongoing coverage of various viewpoints on the topic. The Authority has not upheld a complaint that an interview on Saturday Morning with Baroness Dr Hilary Cass breached broadcasting standards. Dr Cass is the author of an independent review of NHS gender identity services for children and young people in England, whose findings contributed to the New Zealand Government’s decision to ban new prescriptions for puberty blockers to treat gender dysphoria or incongruence. The Authority acknowledged the complainant’s concerns about the harm that could result from the ban on puberty blockers in New Zealand, and that many New Zealand medical member associations have expressed strong concern about it. However, it found the interview was clearly signalled as presenting Dr Cass’s opinion on a controversial and unsettled debate (the long-term safety of puberty blockers in transgender healthcare) and did not breach the balance or accuracy standards....

The Authority has not upheld a complaint that a brief Nine to Noon segment discussing the latest developments in a site investigation at the former Ivon Watkins-Dow (Dow) chemical plant in Paritūtū, New Plymouth lacked balance and accuracy. Noting the nature of the programme, the perspectives included in it and other media, and that the period of current interest for issues at Paritūtū was ongoing, the Authority found reasonable efforts were made to present significant viewpoints. The Authority has not upheld complaints about a Breakfast interview with Labour MP Tangi Utikere. During the interview, Utikere was asked about reports of a ‘leaker’ within the Labour caucus, and was repeatedly questioned on whether he himself was the leaker. The complainants alleged the interview amounted to bullying and denigrated Utikere. The Authority acknowledged the questioning was sustained, but was within the scope of the type of questioning expected of a politician, particularly in the lead up to an election, and the broadcast was not in breach of the fairness standard (with respect to treatment of Utikere or former Minister Kiritapu Allan). The Authority has not upheld a complaint about an interview with a delegate of the New Zealand Nurses Organisation. The complainant alleged that the interview was unfair, unbalanced and inaccurate as the host was rude, offensive, underprepared and did not allow her to read from a prepared statement. The Authority did not uphold the complaint under the fairness standard as, among other reasons, the interviewee was a delegate from a large union, who can be expected to handle robust questioning. The Authority has not upheld a complaint that a TVNZ news report concerning an Israeli military operation in the Occupied West Bank breached the balance and accuracy standards. The Authority found the balance standard was not breached as the requirement to present additional perspectives is reduced for programmes narrowly focused on one aspect of a larger complex matter, and the audience could reasonably be expected to be aware of significant context and viewpoints from other media coverage.  While noting the balance standard is not directed at bias, the Authority also identified no bias in the language used in the broadcast. The Authority has not upheld two complaints about a 1News item reporting on Te Pāti Māori’s ‘reset’, the co-leaders’ reaction to questioning at a media conference, and Te Pāti Māori’s newest MP Oriini Kaipara’s maiden speech in Parliament. The complaints alleged the segment was unbalanced and biased as the broadcast did not report on the temporary suspension of Parliament following haka and waiata after Kaipara’s maiden speech. The Authority found the segment was a straight news report and not a discussion of a controversial issue of public importance, meaning the balance standard did not apply....

The Authority has declined to determine two complaints under various standards, including discrimination and denigration, about an item on Seven Sharp on 28 September 2021. The item reported on employment issues relating to the COVID-19 vaccine. Following an interview with an employment lawyer, the presenters discussed a hypothetical dinner party where a guest turned out to be unvaccinated. The complainants were concerned about the treatment of people that were not vaccinated, who do not amount to a relevant section of society for the purposes of the discrimination and denigration standard. The remainder of the complaint reflected the complainants’ personal views and/or was unrelated to the broadcast. In all the circumstances (including scientific consensus around the safety of the COVID-19 Pfizer vaccine and the impact of the COVID-19 pandemic), the Authority considered it should not determine the complaints....

The Authority did not uphold a complaint alleging an item on 1 News about nurses suffering ‘fatigue and burnout’ breached broadcasting standards. The complainant was concerned for an interviewee’s mental wellbeing and the broadcast’s omission of any interview with the interviewee’s employer or discussion of the employer’s accountability for the situation. The Authority found the balance standard did not apply, as no controversial issue was discussed; the issue of current nurse shortages is a fact. In any event, significant perspectives on the issue were broadcast within the (ongoing) period of current interest. The Authority has not upheld a complaint several broadcasts on RNZ National concerning missiles that crossed into Poland breached broadcasting standards. The complainant alleged the reports were unbalanced, inaccurate as to the ownership of the missiles and other matters, discriminated against Russo and Slavic people, disturbing as they raised the prospect of nuclear war in which children would be harmed, and unfair to children. The Authority did not uphold the complaint under the balance standard as the broadcaster had presented significant viewpoints on the issue and had made reasonable efforts to ensure accuracy in the context of a developing story. The Authority has not upheld a complaint concerning a Sunday investigation report looking into issues with emergency housing in Rotorua, and a follow-up item on 1 News. The majority of the Sunday broadcast focused on allegations against the largest contracted emergency housing provider in Rotorua, Visions of a Helping Hand (Visions), and its contracted security company Tigers Express Security Ltd – both led by CEO/Director Tiny Deane. Visions complained the broadcast was unbalanced, misleading, and unfair to Visions, Tigers Express Security and Deane. Noting the very high public interest and value in the story overall, the Authority found most of Visions’ concerns with the broadcast could have been addressed had it provided a substantive response to the reporter on the issues raised – who had made numerous attempts over more than a month to obtain comment from Visions and Deane....

The Authority has not upheld a complaint that an item on RNZ’s 9am news bulletin about an electricity shortage in New Zealand breached multiple standards. The complaint focused on the broadcast’s allegedly inappropriate use of terms such as energy, fossil fuels, power and electricity and the omission of contextual information. In the context of the news bulletin, the Authority found RNZ’s audience was unlikely to be misled. Accordingly, the accuracy standard was not breached. The remaining standards either did not apply or were not breached.
