Warning: This decision contains coarse language that some readers may find offensive The Authority has not upheld a complaint that the action taken by NZME in response to a breach of the good taste and decency standard during an episode of the programme Bhuja was insufficient. The Authority agreed that the programme breached standards, by failing to signal to viewers that a highly aggressive interview was staged, and by broadcasting offensive language. However, the Authority found the action taken by the broadcaster holding the hosts to account with regard to language used, was proportionate to the breach and any further action would unreasonably limit the broadcaster’s right to freedom of expression. The Authority also found that the fairness, discrimination and denigration, violence and accuracy standards did not apply to the material broadcast. An episode of The Detail explored the Productivity Commission’s recommendation the Government review Aotearoa New Zealand’s regulatory framework around genetically modified organisms to ensure they remain fit for purpose. The complainant stated the broadcast was unbalanced and misleading as it, among other reasons, overemphasised the benefits of GMOs, did not critique the Commission, was inaccurate in several respects, and suggested issues with GMOs were largely ethical rather than scientific. The Authority did not uphold the complaint, finding the broadcast was balanced, particularly as it was focusing on a single issue. The Authority has not upheld a complaint that an item on Breakfast stating ‘20 million tonnes of plastic waste’ was being exported each year breached the accuracy standard. The figure was accepted as inaccurate (with an estimate of 35,000 tonnes more likely). However, in the context of an item focussed on a petition to address the harm caused to other countries as a result of New Zealand’s large-scale plastic waste exports, the Authority found it was unlikely to significantly affect viewers’ understanding of the item as a whole. The Authority has not upheld a complaint that a Newshub Live at 6pm report regarding water fluoridation and the Three Waters proposal breached the balance, accuracy and fairness standards. While the issue of how to improve Aotearoa New Zealand’s fluoridation is a controversial issue of public importance, the report included major perspectives on this issue, including alternatives such as central government orders, imposition of penalties and better data collection, as well as the Three Waters proposal. On this basis the balance standard was not breached. The complainant’s submissions under the accuracy standard concerned analysis to which the standard does not apply. The Authority has not upheld a complaint an episode of The Panel, which discussed Prime Minister Jacinda Ardern’s recent resignation announcement, breached the accuracy standard. During the episode, the host spoke briefly with a caller who raised concerns about COVID-19 vaccine mandates, to which a panellist responded ‘97% of us got vaccinated’. While the Authority acknowledged this statement was inaccurate, it was unlikely to significantly affect listeners’ understanding of the segment which focused on Ardern’s resignation.
