During the item’s introduction, an image of a black and white dog was depicted behind the presenter. The complainant said the image was of a Staffordshire Bull Terrier (‘Staffy) and its use may erroneously ‘encourage viewers to be fearful of Staffies, maybe even encouraging mistreatment’. The Authority found use of the image would not have caused viewers to fear or mistreat Staffies. The item did not suggest certain dog breeds are dangerous. The Authority has declined to determine two complaints under multiple standards relating to segments of a 1News broadcast that concerned a pro-Palestinian protest in Auckland and developments in the Israel-Hamas conflict, and aid funding for Ukraine. The Authority found the complainant had not raised arguments relevant to the standards raised, had raised matters of personal preference, the relevant issues had been satisfactorily addressed in the broadcaster’s decisions on his complaints, and/or related to issues that have previously been dealt with and did not warrant further determination. The Authority has not upheld a complaint, under the promotion of illegal or antisocial behaviour standard, about a 1News report’s reference to protests outside politicians’ homes sometimes being ‘effective, like during the Dawn Raids’. The complainant considered the Dawn Raids protest example, in the context of a story covering damage caused by protesters at Hon Winston Peters’ home, would encourage illegal or antisocial protest behaviour. The Authority found the programme was a straightforward news report covering responses to property damage at Peters’ home and progress of the Summary Offences (Demonstrations Near Residential Premises) Amendment Bill (the Bill). It noted the report included numerous comments condemning the actions by protesters at Peters’ home and outlined the serious consequences suffered by those responsible. References to the Dawn Raids’ protesters were part of a report on comments made in Parliament during the Bill’s first reading....

The Authority has declined to determine a complaint that 1News’ ANZAC Day bulletin, which included coverage of Māori soldiers, the 28th Māori Battalion and a pre-recorded story by 1News’ Māori Affairs Correspondent, breached the discrimination and denigration, balance and fairness standards. The Authority considered the relevant content appropriate to the context of the broadcast, which marked the first ANZAC Day without a surviving member of the 28th Māori Battalion. It also found the complaint reflected the complainant’s own personal preferences on a matter for the broadcaster’s editorial discretion and did not raise any issues of broadcasting standards that warranted determination. The Authority has declined to determine a complaint about a 1News broadcast discussing racial tensions arising from coalition government policies. The item mentioned a 1News Verian poll on whether the coalition government’s policies were increasing, decreasing, or making no real difference to racial tensions in Aotearoa New Zealand. The complainant alleged the broadcast, and the poll were ‘incredibly biased’ and that the broadcast breached the discrimination and denigration, accuracy, balance, and fairness standards. The Authority declined to determine the complaint on the basis it raised issues under the accuracy, balance, and fairness standards that could all be dismissed on grounds previously explained to the complainant; the broadcast could not be considered to encourage discrimination or denigration; and the complaint concerned issues of personal preference and had been adequately addressed in the broadcaster’s decision....

The Authority has not upheld a complaint that a 1News report breached the accuracy standard through its story about the Independent Police Conduct Authority’s findings concerning a fatal shooting. The complainant considered the story misleading for its emphasis on the shooting being ‘unjustified’ without further context, including regarding the ‘fine margin’ of the decision. The Authority has not upheld an accuracy complaint about a 1News segment that reported, ‘Many scientists are concerned the US Health Secretary's decision to pull funding for international vaccine development may increase hesitancy and also mean future pandemics are harder to stop. ’ The complainant alleged the broadcast was inaccurate and materially misleading because it did not specify that US Health Secretary Robert F Kennedy Jr’s decision ‘was specifically about mRNA vaccines’ and  background footage of protesters was irrelevant. While broadcasts can be misleading by omission, the Authority found the item in question was not materially misleading. The brief report centred on the scientific community’s response to Kennedy’s decision and clearly identified that Kennedy’s decision did not impact all vaccines. In this context, further detail about the type of vaccines affected was not material to viewers’ understanding of the broadcast....

The Authority has not upheld direct privacy complaints in relation to broadcasts reporting on a shootout between fugitive Tom Phillips and police, and the location of his two missing children in the bush. The complainant submitted broadcasting the children were ‘cooperative’ with police, and images of their campsite, breached the children’s privacy. Applying the privacy standard, the Authority found these limited details did not attract a reasonable expectation of privacy, noting they had been released by police and were in the public domain, and were not intimate or sensitive in nature. While acknowledging the children’s vulnerability and lack of consent to these details being broadcast, given the significant public interest and concern for the children’s wellbeing, it could reasonably be expected that this limited information about their demeanour and where they were found may be disclosed. The Authority has not upheld a complaint that a 1News item on the government’s proposed amendments to expand citizen’s arrest powers, as part of its efforts to address retail crime, breached the balance standard. The complaint alleged the report ‘crossed the line’ into political bias by focusing on violent robberies and interviewees expressing concerns about increased danger and vigilantism, while failing to mention the proposed changes were intended to address incidents such as supermarket shoplifting. The Authority found the balance standard had not been breached as the item included significant perspectives on the government’s proposal, including comments from Justice Minister Paul Goldsmith’s announcement. The Authority has not upheld a complaint, under the balance and accuracy standards, about an item on 1News reporting on a New Zealand scientist’s research trip to Greenland. The complainant alleged that a comment made by the host that ‘if all the ice in Greenland were to melt, the sea would rise by seven metres,’ was incorrect, as research shows the sea level rise to be occurring at a much lower rate. The Authority did not uphold the complaint, noting reasonable viewers were unlikely to interpret the broadcast in the way the complainant described and were unlikely to be misled by the absence of further supporting information or information regarding who funded the research. The Authority has upheld an accuracy complaint from John Minto on behalf of Palestine Solidarity Network Aotearoa about 1News’ reporting of violence that unfolded in Amsterdam surrounding a football match between the local team Ajax and Israel’s Maccabi Tel Aviv. The reporting comprised a pre-ad-break trailer reporting ‘antisemitic violence’, an introduction by the presenter which included a montage of ‘disturbing’ footage of violence described by Amsterdam’s mayor as ‘an explosion of antisemitism’, and a pre-recorded BBC item. The broadcaster upheld one aspect of the complaint, relating to mischaracterised footage used in the trailer and introduction, which was originally reported as showing Israeli fans being attacked, but later corrected by Reuters and other outlets to indicate it showed Israeli fans chasing and attacking one Dutch man....

The Authority has upheld an accuracy complaint about a statement, ‘Public submissions for Phase Two of the Inquiry closes at midnight tonight’, in a 1News item reporting on the deadline for submissions to the Royal Commission of Inquiry into COVID-19 Lessons Learned. The Authority found the statement was materially inaccurate as the correct deadline was the following night and, in the context of the broadcast, this was a material point of fact. The COVID-19 Inquiry’s communications regarding the deadline for public submissions could have been clearer, but TVNZ did not make reasonable efforts to ensure accuracy. It relied on information from official press releases and communications by the Inquiry but did not seek clarification of the ambiguous deadline from a relevant person/organisation....

The Authority has not upheld two complaints that it was inaccurate for a 1News reporter to state ‘[The International Court of Justice] so far has said it's plausible that genocide is happening on the ground in Gaza’. The complainants alleged the court’s ruling only stated Palestinians had plausible rights to be protected from genocide, rather than finding genocide was plausible. The Authority found the nature of the ICJ ruling represented a statement of fact to which the standard applied, but did not consider the statement was materially misleading taking into account the legal technicalities in the ruling and the subsequent clarification, the continued debate around the ICJ’s ‘plausibility’ test, and the context of the item. The Authority has not upheld two complaints about a 1News item on the Government’s rejection of an application to officially change the town of Russell to its original name, Kororāreka. The complainants alleged an interviewee’s comment that those against the name change were ‘usually older… always white’ was racist and ageist; the accuracy of the same statement was ‘questionable’; and the item was unbalanced, biased and unfair by only including interviews with people who supported the name change....

The Authority1 has not upheld a complaint about a 1News item reporting on the Government’s proposed reform of the Retirement Villages Act 2003. The complainant alleged the segment was unbalanced for not explaining changes to payments in connection with the sale of vacated units will only be applied to new retirement village residents, and not current residents. The Authority found the broadcast provided significant perspectives regarding the proposed reform and did not purport to provide a comprehensive examination of the Government’s proposed changes.  In addition, the standard allows for balance to be achieved over time within the period of current interest, and the broadcaster had covered the issue of impacts on existing residents in reports the next morning. The Authority has not upheld a complaint that a TVNZ news report concerning an Israeli military operation in the Occupied West Bank breached the balance and accuracy standards. The Authority found the balance standard was not breached as the requirement to present additional perspectives is reduced for programmes narrowly focused on one aspect of a larger complex matter, and the audience could reasonably be expected to be aware of significant context and viewpoints from other media coverage.  While noting the balance standard is not directed at bias, the Authority also identified no bias in the language used in the broadcast.
