As part of a news item on ‘main developments overnight’ in the war between Russia and Ukraine, a clip was shown where the presenter stated ‘This is footage we’re seeing from Ukraine, a Russian tank in the capital of Kyiv swerving to drive over the top of a car with someone inside. ’ The complainant alleged this was inaccurate, submitting it was actually a Ukrainian anti-aircraft vehicle which lost control and swerved into the vehicle. The Authority found that the exact type of military vehicle involved in the incident was not material to the broadcast and the accuracy standard did not apply to this point. In terms of whether the vehicle was attributable to Russian or Ukrainian forces, and whether the collision was deliberate, given conflicting reports it was unclear whether the broadcast was misleading on these points....

The Authority has not upheld a complaint about a 1 News item on Tross Publishing, which it reported had been ‘accused of publishing books that are anti-Māori, inaccurate and harmful’ and discussed the use of its books in schools. While the complainant was concerned the broadcast was ‘anti-white’ and ‘anti-immigrant,’ the Authority found it did not encourage the denigration of, or discrimination against ‘white’ people, and that immigrants are not a recognised section of the community for the purposes of the standard. A complaint that a news item which included blurred clips of a politician in a strip club breached the children’s interests standard has not been upheld. The Authority found that the short news item contained brief and inexplicit clips from inside the strip club which were shown in the context of a news item about Australian politics. Generally audiences are aware of the need to exercise discretion during news programming to regulate their own and their children’s viewing. The Authority found that due to audience expectations of 1 News, which is an unclassified news and current affairs programme, the brevity of the clip and blurring applied, the public interest, and the focus of the item being on Pauline Hanson’s response to the resignation of a party candidate, the item would not cause undue harm to children. The Authority has not upheld a complaint that an item on 1 News reporting on the Government’s financial accounts breached the accuracy standard. The complainant alleged the Political Editor’s statement in the item that “…a bigger tax take has meant the deficit is half what was predicted in the May budget, a saving of more than 9 billion” was inaccurate, as it gave the impression that the lower-than-forecast deficit was achieved entirely from a bigger tax take, when almost a third of the saving came from less Government expenditure than predicted. The Authority has not upheld a complaint an item on 1 News breached the complainant and her grandchild’s privacy. The item, which reported on the implications of GP shortages in Northland, included footage of the complainant and her grandchild (who was in a moonboot with crutches) leaving a medical centre, and of them in the waiting room. The Authority acknowledged the sensitive nature of health information and encouraged broadcasters to obtain the consent of persons filmed in a medical centre (particularly where children are involved). However, the Authority found there was no reasonable expectation of privacy in the particular facts disclosed (being attendance at a medical centre) noting the complainant was initially depicted outside the centre, from a public footpath, where there was no expectation of privacy. The Authority has reconsidered and not upheld a privacy complaint about an item on 1 News reporting on residents’ concerns about ‘boy racers’ in a particular Christchurch suburb, following TVNZ appealing the Authority’s original decision to the High Court. The item featured an interview with a resident reported as being ‘too scared to be identified’. The Authority originally found she was identifiable and the High Court dismissed the appeal on that point but directed the Authority to reconsider the remaining issues in light of new affidavit evidence filed by TVNZ in the appeal. Having reconsidered the matter, the Authority remained of the view the disclosure of the woman’s identity in the circumstances would be highly offensive to an objective reasonable person.
