Summary An item broadcast on One Network News between 6. 00–7. 00 pm on TV One on 12 March 1998 reported on the Auckland trial of Malcolm Rewa who had been charged with murder, and several counts of sexual violation. The item referred to evidence given that day by a witness who had been raped by Rewa ten years previously. Footage showed street signs and the streets where the witness had lived and was attacked, and the gang safe house where she was taken after the attack. The report described her as the girlfriend of a gang member, and used her first name. A complaint was made to the TVNZ newsroom by a family member shortly after. The report was repeated unchanged during Tonight, broadcast at 9. 30 pm the same night....

Summary Good Morning’s nutritionist interviewed a representative from the International Soy Advisory Board and demonstrated the use of soy products in cooking in a broadcast by TVNZ on TVOne on 3 May 1999 beginning at 10. 00am. Mr James of Whangarei complained to Television New Zealand Ltd that the programme was unbalanced, unfair and inaccurate as it did not warn viewers of the known health risks of using soy products, nor did it reveal that the guest was either a consultant to or an employee of a company which markets the products. TVNZ responded that the programme did not purport to investigate the merits of soy products, but was essentially a cooking demonstration carried out while the guest discussed the principal ingredient. It maintained that as research on the benefits of soy products was equivocal, it was not in a position to judge whether the broadcast was accurate....

Summary A line from the movie American Anthem which included offensive language was the subject of a complaint. In the movie, two gymnasts fall in love and deal with stressful personal lives, while training for the US national team trials. The movie was broadcast on TV2 on 10 October 1999 beginning at 12. 00pm. Kellie Watkins complained to Television New Zealand Ltd, the broadcaster, that the language was inappropriate for the time of broadcast. TVNZ upheld the complaint as a breach of standards G2 and G12. As a consequence, it reported that the movie was reclassified AO, so that future broadcasts in PGR time would be prevented unless the film was cut. TVNZ also apologised to Ms Watkins and her household. Ms Watkins contended that TVNZ’s action in response to the upheld complaint was inadequate....

INTERLOCUTORY DECISION The Background An item on One News on 23 November 2000 reported on the case of Joanne Procter who was seeking a taxpayer-funded sex change operation. Her application had been approved by doctors at Waikato Hospital, but that decision had been overruled by the Health Funding Authority. She had taken her case to the Ombudsman, and the Chief Ombudsman had ruled that she had been treated unfairly by the health bureaucracy. The Authority has not upheld a complaint under the balance and accuracy standards about a 1News report on the start of a ceasefire deal between Hamas and Israel, and the first hostage/prisoner exchange as part of the deal. The complaint included claims the broadcast: failed to identify the West Bank as occupied; inaccurately cited how many were killed at the Nova festival and the identity of those attending the festival; inaccurately described the origin of the cars in the ‘car wall’; used ‘gratuitous adjectival framing to discredit Palestinian supporters’; and was overall unbalanced. Noting the challenges of verifying certain facts presented in the broadcast, the Authority did not uphold the complaints under the accuracy standard on the basis reasonable efforts had been made to ensure accuracy, or the relevant points were not materially inaccurate or misleading....

The Authority has not upheld a complaint concerning an interview on Breakfast. In a discussion concerning Prime Minister Christopher Luxon’s State of the Nation speech, the host stated to ACT Party Deputy Leader Brooke van Velden ‘You mentioned that, division was from the previous Government. I mean, come on, you look at the Treaty of Waitangi. You must be able to read the room in terms of how the nation is feeling towards that Bill by your party. ’ The complainant considered the host’s implication that this division was caused by ACT’s Treaty Principles Bill was inaccurate, unbalanced and unfair. The Authority found that the question was comment, analysis or opinion to which the accuracy standard did not apply. The other standards either did not apply or were not breached. The Authority has not upheld a complaint that an episode of Highway Cops breached the privacy standard. A segment of the programme focused on a car accident in which the complainant was the victim. It included blurred shots of them being treated on a stretcher post-accident, as well as brief CCTV footage of the accident occurring and the complainant exiting their car and dropping to their hands and knees on the road. The Authority acknowledged the accident was a traumatic event for the complainant, and the impact having the footage aired on national television without their consent had on them....

The Authority has not upheld a complaint regarding an item on 1News covering a Hobson’s Pledge campaign against bilingual road signage. The complaint was that the coverage was biased and unfair by suggesting feedback using the Hobson’s Pledge template was ‘bad’, trying to influence how people gave feedback, and only interviewing members of the public in support of bilingual signage. The Authority found the broadcaster provided sufficient balance and the item was not unfair, as Hobson’s Pledge was given an opportunity to comment, and its position was adequately presented in the item. The complaint did not identify any inaccurate statement or reasons why the item was inaccurate, and the discrimination and denigration standard did not apply.
