The Authority did not uphold a complaint that the item was inaccurate, unbalanced and unfair. The item carefully conveyed a complex issue, was not factually inaccurate and would not have misled viewers in any material respect. While the conflict surrounding the rowing club’s presence at Lake Horowhenua is a controversial issue of public importance, the item included the viewpoints of both parties and was sufficiently balanced. Summary[This summary does not form part of the decision. ]An item on Checkpoint reported on the final stages of a court case in Auckland, known as the ‘Dome Valley’ kidnapping, in which a young woman was kidnapped, beaten, sexually violated and left to die by a group of her former friends. The reporter outlined the events of the kidnapping and the item featured segments of the victim giving evidence (with her voice disguised) via audio-visual link from another room in the closed court. The reporter and the victim outlined her assault and injuries in some detail. No audience advisory was broadcast....

Summary[This summary does not form part of the decision. ]During the Saturday Morning programme on RNZ National, Kim Hill interviewed Dr Don Brash about his views on the use of te reo Māori in New Zealand. At one point in the interview Ms Hill put to Dr Brash, ‘Is this a political position on your part? I mean, we know your political position, for example, which says that the government has no responsibility to address the overrepresentation of Māori in negative social stats’. Dr Brash asked Ms Hill when he had said that, to which Ms Hill replied, ‘I’m quoting you. I think it was about seven years ago’. The Authority declined to determine a complaint that Ms Withers was not suitable to interview. RNZ's decision to interview Ms Withers is a matter of editorial discretion rather than broadcasting standards. The complainant has previously made similar complaints about Ms Withers and been warned that further similar complaints would be unlikely to be determined in future. Accordingly the Authority declined to determine the present complaint on the basis it was vexatious. The Authority has not upheld a complaint that replacement programming broadcast on RNZ National instead of Children’s Storytime breached the children’s interests standard. On 17 March 2019, shortly after the 15 March 2019 attacks on two mosques in Christchurch, instead of the usual Children’s Storytime, RNZ played excerpts from the podcast Public Enemy, a four-part series from 2016/17 looking at growing up Muslim in the post September 11 world. The Authority found that while the replacement broadcast contained material that could be disturbing for children, and while there was a greater chance of children tuning in due to the usually scheduled programming at that time, the broadcaster took steps to adequately inform listeners of the nature of the programme. This would have enabled caregivers to decide whether the content was suitable for children in their care....

Summary The word "nigger" was used by presenter Kim Hill in Nine to Noon broadcast on National Radio on 3 May 2000 just after 11. 00am. John Lowe complained to Radio New Zealand Ltd, the broadcaster, that the use of the word was unacceptable and unnecessary on public radio, and breached the good taste and decency standard. RNZ explained that the word arose in the context of a discussion about the origin of the word "munted" which had apparently been used on the programme earlier that day. According to a fax received from a South African listener, the word "munted" had the same derogatory meaning as "nigger"....

The Authority has not upheld a complaint about an interview with Dame Jacinda Ardern on RNZ National, in which presenter Jesse Mulligan used the word ‘prick’ when asking Ardern about a past comment she made in Parliament. The complaint alleged the use of this language breached multiple standards. The Authority has not upheld a complaint under the balance and accuracy standards about two RNZ National news bulletins reporting on comments by Magma Healthcare Director Dr Simon Snook about the increase of abortions in 2024. In both broadcasts, Dr Snook attributed the increase in abortions to the increased availability of abortion services. The complainant alleged the broadcasts were unbalanced as they only featured Dr Snook’s comments and Snook’s description of abortions as ‘care’ was inaccurate. The Authority found the brief, straightforward items did not amount to ‘discussions’ of a ‘controversial issue of public importance’ for the purposes of the balance standard. The interview focused on the Prime Minister’s recent pregnancy announcement and parenthood. At the beginning of the interview, Mr Gayford was introduced as the ‘Prime Minister’s partner’. The complainant submitted that the broadcast was inaccurate and misleading because Mr Gayford should have been introduced as the Prime Minister’s ‘publicist’. The Authority declined to determine the complaint on the basis it was frivolous and trivial and did not reach the threshold for being considered under the accuracy standard. The Authority has declined to determine a complaint about an item on Nights, which discussed the New Zealand Book Council’s initiative to create a men’s book club, with the aim of encouraging more men to read books. Mr Golden complained that the item was inaccurate. He submitted that men should not be encouraged to read more books, as paper-based books were, for example, heavy, spread unwanted bacteria and could cause eye problems. The Authority declined to determine the complaint on the basis that it was frivolous and trivial, and ordered the complainant to pay a reasonable portion of costs to the broadcaster to compensate for the time and resources spent in dealing with the complaint. The Authority has not upheld a complaint about a Midday Report segment on Charlie Kirk’s death, which included a recording of Kirk’s final interaction and the gunshot which killed him. The complainant considered it offensive and lacking in decency to broadcast Kirk’s final moments. In the context, including comments alerting listeners to the pending content, the Authority found it was unlikely to disproportionately offend or disturb the Midday Report audience. Those who did not wish to listen were given a reasonable opportunity to turn the programme off. Noting the significant public interest in the segment, the Authority also found no harm justifying its intervention to limit the broadcaster’s freedom of expression.
