Ms Penfold referred to the complainant’s documentary, Gloriavale: A Woman’s Place, saying, ‘And I know a little bit about how that works with Hopeful Christian, the leader at Gloriavale. You know, he will insist on editorial control’. The Authority did not uphold a complaint that Ms Penfold’s statements were inaccurate. Ms Penfold’s statement represented her own analysis, comment or opinion, based on her experiences at Gloriavale, and so was not subject to the accuracy standard....

The Authority has declined to determine a complaint alleging a brief news bulletin on Radio New Zealand’s RNZ Concert breached the balance and accuracy standards in reporting statements by US Vice President JD Vance. The Authority declined to determine a complaint regarding a news item covering the expansion of a sexual violence court pilot. The complainant submitted that the victim advocate interviewed in the item should not have been interviewed and should not have been referred to as a rape survivor. The Authority concluded that, in all the circumstances of the complaint, it should not be determined by the Authority. The Authority found the concerns raised in the complaint are matters of editorial discretion and personal preference rather than broadcasting standards, and are therefore not capable of being determined by the broadcasting standards complaints procedure. The Authority has not upheld a complaint that an interview by Kim Hill with former nun and lesbian activist Monica Hingston breached broadcasting standards by including the suggestion that the Catholic Church, and by connection, all Catholics are corrupt. The Authority found that the interview did not contain a high level of condemnation, nor would it undermine community standards of good taste and decency, as it was a nuanced, considered conversation that was narrowly focused on Ms Hingston’s personal views and experiences with the Catholic Church. Taking into account public interest in the interview and the fact that the interview was clearly signalled as being from Ms Hingston’s perspective, the Authority also determined that it did not result in any unfairness to the Catholic Church. The Authority has not upheld a complaint that a broadcast on Radio New Zealand National’s Saturday Morning breached the balance, accuracy, and fairness standards. The broadcast was an interview of a UNICEF spokesperson and humanitarian worker about her experience living and working in Lebanon amid the ongoing Israel-Hamas-Hezbollah conflict. The Authority found the broadcast was clearly signalled as being from the interviewee’s perspective and was not claiming nor intending to be a balanced examination of perspectives on the conflict. The audience also could reasonably be expected to be aware of significant context and viewpoints from other media coverage. Regarding accuracy, the Authority found the likelihood of a listener being misled by omission of any of the identified perspectives and context was significantly reduced, noting other media coverage of the conflict....

Summary[This summary does not form part of the decision. ]An item on RNZ News reported on the Voluntary Euthanasia Society NZ’s (VES) calls for government action following a recently published study that indicated strong public support for some form of lawful assisted dying. The Authority did not uphold a complaint that this item inaccurately reported the findings of the study, and lacked balance. This was a short news report which accurately conveyed the key findings of the study to the listener. In the context of the item, it was not practical or necessary to convey the detailed nuances of the study’s findings. While the item touched on the broader issue of euthanasia, it simply reported on the findings of the study and did not amount to a discussion of the wider issue which triggered the requirements of the balance standard....

The Authority has declined to determine a complaint about a political commentator’s use of the phrase ‘not piss … them off too much’ when discussing Coalition Government tensions. The complainant argued the phrase was offensive. The Authority1 has not upheld a complaint that interviews on The Detail discussing a ‘power imbalance’ between retirement village operators and residents breached the balance, accuracy and fairness standards. The complainant alleged the broadcast was unbalanced and unfair as it did not provide an alternative perspective from a retirement village operator or the industry, and the statement, ‘operators are just sitting on the weekly fee’, was inaccurate. The Authority found the broadcast was signalled as coming from a particular point of view and viewers were unlikely to expect a countering perspective in the broadcast. The Authority also found the alleged inaccurate statement was clearly distinguishable as analysis, comment or opinion and was not materially misleading. The fairness standard did not apply. The Authority has not upheld a complaint that two RNZ broadcasts, a week apart — Morning Report and The Detail — about New Zealand’s low-risk alcohol drinking guidelines were unbalanced and inaccurate. The Authority found that any inaccuracies regarding Canada’s alcohol guidelines were not material in the context of the overall broadcasts. With respect to balance, the Authority found the Morning Report broadcast was clearly signalled as focussing on one aspect of the much larger, complex debate on alcohol policy. Although the complainant was mentioned once during Morning Report, in the context the audience would not have expected a countering viewpoint to be presented from the complainant or the industry. The Detail carried significant public interest and sufficiently alerted listeners to alternative perspectives through a comment from the Executive Director of the New Zealand Alcohol Beverages Council and the host’s use of ‘devil’s advocate’ questioning. UFG complained the report inaccurately stated all florists had elected to remain anonymous, was unfair to UFG by inadequately reflecting its response to the concerns raised, and was unbalanced, in breach of the accuracy, fairness and balance broadcasting standards. Summary Gary McCormick, a guest on National Radio’s Nine to Noon on 22 July 1999, joked with the host about a news report that day that an IRD employee had offered to forego an audit of some prostitutes in exchange for free sex. Referring to a Civil Aviation Authority report on an air accident reported that day, he joked that he would ask the CAA to provide a warrant for his car. Mr Boyce complained to Radio New Zealand Ltd, the broadcaster, that the exchanges were inappropriate. When he did not receive a response from RNZ within the statutory time limit, he referred the complaint to the Broadcasting Standards Authority under s. 8(1)(b) of the Broadcasting Act 1989. The Authority sought RNZ’s comments on the complaint. It reported that it had responded to the complaint 19 working days after its receipt....

Summary[This summary does not form part of the decision. ]A complaint about an interview between Kim Hill and US Palestinian writer and journalist Dr Ramzy Baroud was not upheld. The complaint was that the interview was unbalanced because there was no alternative perspective presented to counter Dr Baroud’s views that Israel’s actions amounted to ‘incremental genocide’ of the Palestinians, among other things. The Authority found RNZ made reasonable efforts as required by the balance standard, taking into account Ms Hill’s challenging of Dr Baroud and the use of devil’s advocate questioning, and other contextual factors. The Authority acknowledged that some may not agree with the terms used by Dr Baroud during the interview, but ultimately found that restricting the broadcaster’s or Dr Baroud’s right to freedom of expression would be unjustified....
