The Authority has not upheld two complaints regarding an interview of American philosopher and gender theorist Judith Butler by Kim Hill. The interview discussed ‘the debate about who can be classified as a woman’ and used the term ‘TERF’, an acronym meaning trans exclusionary radical feminist, to describe those ‘who oppose transgender as a phenomenon and transgender rights more broadly’, particularly through excluding trans people from women-only spaces. The Authority found the broadcast was not discriminatory towards women and the term ‘TERF’ was used as part of a discussion of the debate and the expression of legitimately held opinion. The Authority has declined to determine a complaint regarding a news item which included a quote from Liz Cheney calling Donald Trump’s claims that he had won the 2020 US Election ‘dangerous lies’. The complainant was concerned about RNZ referring to some politicians as liars but not others. The Authority has not upheld complaints an interview on Saturday Morning between Kim Hill and Dr Kathleen Stock, a gender critical philosopher, breached broadcasting standards, including the discrimination and denigration, balance and accuracy standards. The broadcast discussed Dr Stock’s perspective on gender identity and her experiences resulting from voicing her perspective, having resigned from her position following a student campaign that accused her of transphobia. The Authority acknowledged the potential harm of the interview, but ultimately found the importance of freedom of expression outweighed any harm caused. The broadcast was clearly signalled as presenting Dr Stock’s perspective, to which she was entitled, and throughout the interview Hill challenged Dr Stock’s views, leaving the audience with a more balanced impression on the issue....

The Authority did not uphold a complaint about four items on Morning Report covering an open letter to Government calling for ‘a major overhaul of the drug laws’. The Authority found the items did not breach the balance standard, as, while they discussed a controversial issue of public importance to which the balance standard applied, a reasonable range of perspectives were included, particularly given they were reporting on the publication of the open letter. In the context of items covering a challenge to the status quo, and when debate around drug reform is an ongoing issue in New Zealand, it was unlikely that listeners would have been left uninformed or unaware there were other perspectives on this issue. The Authority has not upheld a complaint under the balance standard concerning an RNZ news item reporting on fires at cell phone towers in Auckland. The item noted in Britain dozens of cell towers have been set alight reportedly by people who believe 5G technology was spreading COVID-19. The complaint was that the item should also have pointed out the ‘existence of serious and responsible groups who peacefully oppose 5G’. The Authority found the item was a brief, straightforward news report which did not amount to a ‘discussion’, therefore the balance standard and the requirement to present alternative viewpoints did not apply. The Authority declined to determine a complaint about an interview with National Party MP and Leader of the Opposition Christopher Luxon. The complaint alleged the interview was disrespectful and biased, with the interviewer interrupting and expressing their own political views. The Authority has consistently not upheld complaints of a similar nature, and this complaint did not raise any specific issues which would distinguish it from the previous findings on the same issue. The Authority has not upheld a complaint that replacement programming broadcast on RNZ National instead of Children’s Storytime breached the children’s interests standard. On 17 March 2019, shortly after the 15 March 2019 attacks on two mosques in Christchurch, instead of the usual Children’s Storytime, RNZ played excerpts from the podcast Public Enemy, a four-part series from 2016/17 looking at growing up Muslim in the post September 11 world. The Authority found that while the replacement broadcast contained material that could be disturbing for children, and while there was a greater chance of children tuning in due to the usually scheduled programming at that time, the broadcaster took steps to adequately inform listeners of the nature of the programme. This would have enabled caregivers to decide whether the content was suitable for children in their care....

The Authority has not upheld a complaint alleging an interview with Waikato University senior lecturer in psychology Dr Jaimie Veale was inaccurate and unbalanced. While the item discussed a controversial issue of public importance, the selection of a transgender woman to the New Zealand Olympic team, it was clearly signalled as coming from a particular perspective. It focused on one aspect of the issue, the potentially stigmatising effect of the debate on trans people, and was part of a range of media coverage on the issue. The Authority has accepted jurisdiction to consider a complaint under the privacy standard made by the Privacy Commissioner.
