Broadcast [1] During Morning Report, broadcast on Radio New Zealand National between 6am and 9am on 20 February 2009, the host spent approximately six minutes interviewing the President of the South African Rugby Union. They discussed the possibility of revising the Union’s rules against playing racially selected sports teams, to allow a rugby game between the New Zealand Māori team and the South African team. The item was introduced with a brief sound effect of a woman giving birth. [2] James Cone complained to Radio New Zealand Ltd, the broadcaster, that the audio was gratuitous, distressing and socially irresponsible. [3] In response, RNZ said that the audio was neither socially irresponsible, nor was it intended to cause alarm....

The Authority did not uphold a complaint that an interview with Hon Paul Goldsmith on Morning Report breached the balance and fairness standards. As the complaint did not specify a particular ‘controversial issue of public importance’ the balance standard did not apply. The Authority highlighted the value of robust political discourse and the vital role of media in encouraging and engaging in such discourse. The Authority has not upheld a complaint that an item covering the Electricity Authority’s new trading rule breached the accuracy and fairness standards. The item was materially accurate, given its focus was the introduction of a new trading rule, motivated in part to address an undesirable trading situation (associated with Meridian Energy’s actions). The Authority did not uphold a complaint that two interviews on Morning Report with contributors to the recent report ‘He Waka Roimata: Transforming our Criminal Justice System’, published by the Te Uepū Hāpai i te Ora: Safe and Effective Justice Advisory Group, breached the balance and accuracy standards. The Authority found that the clear perspective and focus of the interviews, combined with the public interest and ongoing nature of the issue discussed, resulted in a balanced broadcast that would assist listeners in arriving at informed and reasoned opinions. The Authority also found that statements made by a host and an interviewee regarding the ‘three strikes’ law were not statements of fact to which the accuracy standard applied. The Authority has declined to determine a complaint regarding a news item which included a quote from Liz Cheney calling Donald Trump’s claims that he had won the 2020 US Election ‘dangerous lies’. The complainant was concerned about RNZ referring to some politicians as liars but not others. The Authority found the content of the complaint did not relate to the substance of the broadcast, and was not capable of being properly determined by a complaints procedure. Summary[This summary does not form part of the decision. ]A complaint about an interview between Kim Hill and Rt Hon Winston Peters regarding the relationship between New Zealand First and the Labour Party was not upheld. The complainant submitted the interview was unbalanced because Kim Hill’s interviewing of Mr Peters was ‘biased, rude and condescending’. The Authority found that, while Ms Hill asked Mr Peters challenging and critical questions, Mr Peters had a reasonable opportunity to put forward his competing point of view. Given the level of public interest in the interview, Mr Peter’s position and his experience with the media, the Authority also found Ms Hill’s interview style did not result in Mr Peters being treated unfairly....

The Authority has not upheld a complaint that an interview on Morning Report with the new leader of the National Party, Christopher Luxon MP breached the discrimination and denigration standard. During the interview, Luxon was asked questions around his Christian beliefs and the impact of these beliefs on his political views on abortion, euthanasia and same-sex marriage. The Authority did not uphold a complaint that an interview on Morning Report with Martin Sellner, the leader of an Austrian far-right group, was unbalanced or misleading. Interviewer Corin Dann questioned Mr Sellner on the donation he had received from the alleged Mosque attacker and Mr Sellner’s choice to give some of the money to Victim Support, a charity assisting victims of the Mosque attacks. In response to other questions, Mr Sellner also provided some comment regarding his ideologies. During the interview, Mr Dann questioned whether Mr Sellner had a role in radicalising the alleged attacker and whether Mr Sellner felt any responsibility for the attacks. The Authority found that the balance standard was not breached considering the clear approach of the broadcast, focussing on the perspective of Mr Sellner, the introduction prior to the interview and Mr Dann’s questioning of Mr Sellner....

The Authority has not upheld a complaint under the balance and accuracy standards about an interview on Morning Report with ‘[a]n Iranian woman, living in New Zealand … shocked by the scale of attacks from Israel on Iran’. The complainant alleged the broadcast ‘presented a one-sided narrative critical of Israel’, and omitted significant viewpoints — namely, those of ‘pro-Israel Iranians’ — and vital context. The complainant also alleged the broadcast contained material inaccuracies, by indicating Israel targeted residential buildings and misled listeners regarding the Iranian regime and Israel’s intentions. The Authority found the broadcast was not claiming nor intending to be a balanced examination of perspectives on the conflict. The audience could also reasonably be expected to be aware of significant context and viewpoints from other media coverage....

The Authority has not upheld a direct privacy complaint about an interview on Morning Report following the stabbing of an Auckland dairy worker. The interviewee (the local Neighbourhood Support Coordinator) speculated about who the victim could be and gave information about the living arrangements of the family who operated the dairy. The Authority did not find any breach of the privacy standard in relation to the victim’s family, on the basis the information disclosed did not attract a reasonable expectation of privacy. It noted in any event that the identity of the victim was officially confirmed soon after, and reporting on the circumstances surrounding the stabbing carried high public interest. The Authority has not upheld a complaint that an interview with a woman concerning her removal from an anti-co-governance meeting on Morning Report breached the balance, fairness and accuracy standards. The complainant alleged the broadcaster should have included balancing comment from, or interviewed Julian Batchelor (the speaker at the event concerned). The Authority found the interview did not require balancing comment as it did not ‘discuss’ the issue of co-governance, and did not treat Batchelor unfairly. The woman’s removal alone did not constitute a controversial issue of public importance. The accuracy standard did not apply as the complainant did not allege any statements were misleading. SummaryA news report on Radio New Zealand’s Morning Report on 20 November 1998 at about 7. 30am stated: "In Israel more land is to be handed over to the Palestinians". Ms Zarifeh, on behalf of the Wellington Palestine Group, complained to Radio New Zealand Ltd, the broadcaster, that the report was inaccurate. She pointed out that the land in question was not in Israel, but was illegally occupied by Israel. It was wrong, she continued, to convey the impression that Israel was somehow being generous in giving the land away. The Group had complained about such inferences in reporting on a number of occasions in the past, she noted, and it was unfortunate that RNZ had "resumed the practice of mislabelling the boundaries of the Middle East....

The Authority has not upheld a complaint that an interview with Simon Bridges, National Party leader and Leader of the Opposition, was in breach of the accuracy, balance and fairness standards. The complainant submitted that the interviewer’s description of a tweet from National MP Chris Penk regarding the Abortion Legislation Bill as ‘fake news’, ‘misinformation’, and ‘wrong’ was inaccurate. The Authority found that this description amounted to comment and analysis, to which the accuracy standard does not apply. The Authority also found that the interview was balanced, as it was reasonable for the interviewer to take a position opposing that of Mr Bridges, and Mr Bridges was given ample opportunities to present his perspective on issues discussed....

The Authority did not uphold a complaint about an item on Morning Report discussing data showing Wellington to have the highest assault and sexual assault rates. Discussing the causes for this, the interviewer posed the question: ‘Do we have a problem with masculinity here? ’ and a discussion followed regarding the potential contribution of ‘toxic masculinity’ to Wellington’s crime rate. The Authority found the term did not carry the derogatory connotations suggested and the item did not contain the high level of condemnation or malice towards men required to contravene the standard.
