The Authority has not upheld an accuracy complaint about a statement by RNZ’s Morning Report host, ‘Māori have a clearly proven proprietary right over water… the Supreme Court has acknowledged that’, during an interview regarding the National Party’s Local Water Done Well policy. The complaint alleged there was no case in which the Supreme Court had made such a statement. The Authority found the statement was not materially inaccurate or misleading in the context of the broader discussion: most audience members would not have interpreted the statement in a strictly legal sense or appreciated the technical legal distinctions drawn in the complaint. The key point being made by the host was that National would need to ensure Māori interests in water were adequately dealt with – or risk facing further litigation – since its policy removed co-governance as a feature. The Authority has not upheld a complaint about an item on Morning Report and a summary bulletin that discussed complaints about Kāinga Ora tenants forcing people to leave their homes. Kāinga Ora complained it was not given an opportunity to comment on one of two situations discussed during the broadcast, which led to the item being unbalanced, and was unfair to the agency. Noting the issue, and numerous similar cases, had been discussed over a number of months in RNZ reporting, the Authority found it was not required in the interests of either balance or fairness for Kāinga Ora to be given a specific opportunity to comment in relation to that particular case. In any event, the Housing Minister’s response, which referred to Kāinga Ora treating complaints seriously and its updated processes for dealing with complaints, was adequate to address the issues raised. The Authority has not upheld a complaint that two interviews on Morning Report, which explored the propriety of funding for a campaign to encourage Māori to register on the Māori electoral roll, breached the balance and accuracy standards. The complainant said the interviews with Merepeka Raukawa-Tait, Chair of the Whānau Ora Commissioning Agency (WOCA) which funded the campaign, and with Hon Shane Jones, who was asked to comment on the issue, displayed ‘anti-Māori bias’. Noting the broadcast incorrectly stated WOCA was a government agency, the complainant also said listeners would be left with an impression there was corruption taking place based on a false assumption. The Authority found the balance standard was not breached as significant perspectives about the advertising campaign were presented in the broadcast and in other media within the period of current interest....

The Authority has declined to determine a complaint about a political commentator’s use of the phrase ‘not piss … them off too much’ when discussing Coalition Government tensions. The complainant argued the phrase was offensive. The Authority has not upheld a complaint that a segment on Morning Report breached the discrimination and denigration, and accuracy standards. The report was about trans men and non-binary people missing out on notifications for cervical screenings, due to how gender and sex are recorded by health services. The Authority found that the discrimination and denigration standard was not breached as the terminology used was specifically chosen to be inclusionary rather than exclusionary, and the inaccuracies alleged by the complainant were immaterial to the broadcast as a whole. The Authority has not upheld a complaint under the balance and accuracy standards about an interview on Morning Report with ‘[a]n Iranian woman, living in New Zealand … shocked by the scale of attacks from Israel on Iran’. The complainant alleged the broadcast ‘presented a one-sided narrative critical of Israel’, and omitted significant viewpoints — namely, those of ‘pro-Israel Iranians’ — and vital context. The complainant also alleged the broadcast contained material inaccuracies, by indicating Israel targeted residential buildings and misled listeners regarding the Iranian regime and Israel’s intentions. The Authority found the broadcast was not claiming nor intending to be a balanced examination of perspectives on the conflict. The audience could also reasonably be expected to be aware of significant context and viewpoints from other media coverage....

The Authority has not upheld a complaint alleging an item on Morning Report misrepresented the Hawke’s Bay Regional Council’s views responding to iwi concerns about groundwater issues, including why local streams were drying up, and did not properly examine the complexity of the issues. The Authority found no breach of the balance standard as the item focused on one aspect of the issue and was clearly presented from the iwi’s perspective, and there is ongoing coverage of various viewpoints on the topic. The Authority has not upheld a complaint about Sports Chat on RNZ’s Morning Report, during which the guest commentator briefly summarised violence surrounding the Maccabi Tel Aviv football match against local Dutch team Ajax in November in Amsterdam, including: ‘the Amsterdam Mayor has come out and said, look, criminals on scooters searched the city for Maccabi supporters in hit-and-run attacks. …said [they were] all antisemitic. ’ The complaint was that RNZ ‘severely distorted’ the context of the events to the point of inaccuracy; discriminated against and denigrated ‘the Amsterdam people who responded to Maccabi’s racist provocations’ and immigrants, by ‘choosing to represent this as antisemitism’; and lacked balance and fairness by excluding Amsterdam locals’ perspective. The Authority did not uphold the complaint, finding the brief summary of the Amsterdam mayor’s response was not materially misleading in the context of Sports Chat, and the remaining standards did not apply....

The Authority has not upheld a complaint that it was a breach of broadcasting standards for an expert interviewee to suggest the anti-mask/anti-vaccination movement was behind bomb threats made to several New Zealand schools. The Authority found that while the issue of who was responsible constituted a controversial issue of public importance, the interview was clearly signalled as approaching the issue from a particular perspective, so the balance standard was not breached. The Authority has not upheld a complaint that an interview with an Israeli soldier on Morning Report breached several standards. The complainant alleged statements made by the interviewee were inaccurate, discriminated against Palestinians and Middle Eastern people, and were offensive and disturbing and unbalanced. The Authority found that the statements of the interviewee were comment, analysis or opinion to which the accuracy standard does not apply and, if not, the broadcaster had made reasonable efforts to ensure accuracy. The Authority also found the comments were not directed at Palestinians and Middle Eastern people and were, in any event, serious comment, analysis or opinion to which the discrimination and denigration standard does not apply; the comments did not seriously violate community standards of taste and decency; and the interview did not breach the balance standard noting it was clearly signalled as presented from a particular perspective....

The Authority has not upheld a complaint alleging an interview with Waikato University senior lecturer in psychology Dr Jaimie Veale was inaccurate and unbalanced. While the item discussed a controversial issue of public importance, the selection of a transgender woman to the New Zealand Olympic team, it was clearly signalled as coming from a particular perspective. It focused on one aspect of the issue, the potentially stigmatising effect of the debate on trans people, and was part of a range of media coverage on the issue. The Authority has made the following directions in respect of the Waikato District Health Board’s referral: declined to accept the two affidavits submitted as part of the WDHB’s complaint invited the WDHB to provide alternative evidence to support its complaint referral, with reference to the formats outlined at paragraph [8] by 24 January 2022 asked RNZ to identify information it wishes to rely on by 24 January 2022, and the WDHB to provide confirmation as to whether such information is in dispute or can be accepted as correct within a further 10 working days invited any further comment from the parties regarding the management of these issues by 24 January 2022....

The Authority has not upheld a complaint that an interview on Morning Report following the US Supreme Court decision overturning Roe v Wade (regarding rights to abortion) breached the balance standard. The complainant alleged the broadcast was unbalanced as both interviewees chosen were from the ‘pro-choice’ perspective, and the ‘pro-life’ point of view was not mentioned, nor a ‘pro-life’ interviewee included. The Authority found that while abortion access and related laws constitute a controversial issue of public importance, the full broadcast (in particular the news report immediately prior covering reactions in the US) included viewpoints from both sides of the issue. Further, the nature of the issue is such that the public can reasonably be expected to be aware of the major perspectives in the debate through ongoing media coverage. Not Upheld: Balance...

The Authority upheld aspects of seven complaints under the privacy and fairness standards, regarding broadcasts by RNZ which included material stolen from the Waikato District Health Board and released by hackers on the dark web. The broadcasts were about a child under the care of Oranga Tamariki, who was effectively ‘living’ in a WDHB hospital because Oranga Tamariki was unable to find them a placement. The Authority found the child was identifiable and their privacy was breached on a segment on Morning Report. While there was a legitimate public interest in the story, this did not extend to all the details included in the item. The Authority also found the Morning Report segment breached the privacy of the child’s family but not of the social worker involved. The fairness standard was also breached as the broadcasts were unfair to the child and their family....

The Authority has not upheld a complaint that an item on RNZ National’s Morning Report on 14 January 2022 breached the discrimination and denigration standard by voicing-over comments made by international students. The complainant alleged this implied that foreign students and immigrants are not easily understood due to their accents, thereby reinforcing xenophobia. The Authority found ‘international students’ and ‘immigrants’ did not constitute relevant sections of the community for the purposes of the standard. The Authority has not upheld a complaint that a broadcast of Morning Report breached the accuracy standard through its reporting on research conducted by the New Zealand Institute of Economic Research. The research indicated ‘At Level 1, among teachers who at least had attempted to gain credits in any of English, maths or science, significant percentages failed to gain an Achieved level endorsement (the NCEA equivalent of a subject pass). ’ The complainant considered the broadcast misleadingly implied an alarming number of primary teachers were unqualified to be teaching these subjects, by failing to make clear that further study was needed to qualify as a primary school teacher, or that an Achieved level endorsement at Level 1 is an optional award....
