INTERLOCUTORY DECISION The Background [1] Detailed claims from the book "Seeds of Distrust", written by Nicky Hager and published on 10 July, were put to the Prime Minister by interviewer John Campbell during a 3 News Special broadcast at 7. 00pm on the same day. The interview had been recorded the previous day (9 July). The book, which was not mentioned during the interview, alleged that the Government was aware of the accidental distribution of GM contaminated seeds and had allowed the seeds to be grown, harvested and processed....

Summary An episode of Sex and the City told the story of a man who exclaimed the words "fucking bitch" during sexual intercourse. Sex and the City was broadcast weekly on TV3 at 9. 30pm and the episode complained about was screened on 5 June 2001. Grant Nesdale complained to TV3 Network Services Ltd, the broadcaster, that the language was offensive. Summary A hidden camera was used on a Target programme broadcast on TV3 on 9 July 2000 to assess whether a car’s wheel alignment had been properly carried out. The footage broadcast included pictures of the outside of the business premises, and members of the staff dealing with the customer. Chris Clarke, the proprietor of Action Auto Services, complained to the Broadcasting Standards Authority about the broadcast, arguing that the filming had been carried out unlawfully on his premises. SummaryA film called The Cowboy Way, broadcast by TV3 Network Services Ltd, on 23 September at 8. 30pm, featured actors Woody Harrelson and Kiefer Sutherland as two cowboys who travelled to New York to find the killer of their friend. Mr Standen complained to TV3 that a scene in the film depicted a calf being prepared by the cowboys to suckle on a man’s penis as a form of torture. He claimed the scene was depraved and pornographic, and should not have been broadcast. In describing the film, TV3 stated that the two central characters, while trying to find their friend’s killer, used methods they had learned as cowboys to survive in the city and elicit information about the killing. It maintained that the "suckling calf torture" scene was intended to be humorous and was not pornographic....

Summary A rugby coach found guilty of sexually assaulting young boys in his rugby club was described on a 3 National News item broadcast on 31 July 1998 as a "homosexual paedophile" and, according to a sports reporter on a 3 News Update item broadcast on 2 August 1998, the Gay Games contained events such as handbag throwing and the 200m dash in high heels. Calum Bennachie complained to TV3 Network Services Ltd that the description of the rugby coach implied that all paedophiles were homosexual or that all homosexuals were paedophiles, and that both implications were factually incorrect and portrayed gay and lesbian people as inherently inferior. He also complained that the emphasis on fringe events in the report on the Gay Games trivialised the achievements of the competitors....

SummaryThe arrest of Headhunter gang members was covered in an item broadcast on 3 News on 11 December 1998. Russell Gillies complained to TV3 Network Services Limited, the broadcaster, that because the item had shown footage of gang members giving the camera, and therefore the viewer, "the fingers", it had failed in its responsibility to maintain standards of good taste and decency. Mr Gillies described the gesture as a defiant act which was intended to be an insult, and argued that the inclusion of it in the item was offensive. TV3 advised Mr Gillies that after viewing the item, and examining the context in which "the fingers" symbol was shown, it had concluded that currently accepted norms of decency and taste had not been breached.
