An application by TV3 Network Services Ltd for an interim injunction failed in the High Court: CP 81/99 PDF2. 73 MB INTERIM DECISIONA number of complaints were referred to the Broadcasting Standards Authority concerning a 20/20 item entitled "Sex, Lies and Videotape" broadcast on TV3 on 28 June 1998 and a related news item broadcast on 3 News on 29 June 1998. There has been extensive correspondence between the complainants, the broadcaster and the Authority in the intervening months. On 24 March 1999, the Authority received advice from the solicitors acting for TV3 in which they noted that four of the principal complainants had alluded to the possibility of taking defamation proceedings against TV3. It used fun and unusual games to look at love, sex and relationships. In a segment in the programme broadcast on 7 July 2001, Leanne, a contestant was asked to identify her fiance from a group of five men. Each man was concealed in a large filing cabinet and the penis was the only part of each man’s body that Leanne saw. Each penis had been "dressed" to represent a famous detective character....

D J Hamilton complained to TV3 Network Services Ltd, the broadcaster, that the map was factually inaccurate. He said it could be "subconsciously misleading" to students of geography and to the viewing public. SummaryMore than 20 promotions for Lion Red beer were screened during Lion Red: The Game, broadcast on TV3 between 8. 30–9. 30pm on 6 August 1998. On GALA’s behalf, Mr Cliff Turner complained to TV3 Network Services Ltd that the broadcast breached the requirement in the standards to minimise the promotion of liquor. The guidelines to the standards, he wrote, suggested that liquor promos should not exceed one every three minutes during the full viewing period. Taking into account the titles, the supers and the Lion advertisements broadcast during the programme, TV3 upheld the complaint that incidental liquor promotion had not been minimised. The titles and the supers had since been altered, it advised, to remove the actual Lion Red logo. Dissatisfied with the action taken, Mr Turner on GALA’s behalf referred the complaint to the Broadcasting Standards Authority under s. 8(1)(a) of the Broadcasting Act 1989....

Summary [1] The Big OE was a series broadcast on TV3 on Thursday nights at 8. 00pm which followed a group of young New Zealanders on a 21-day tour around Europe. [2] Trevor Dixon complained to TV3 Network Services Ltd, the broadcaster, that the episode broadcast on 29 November 2001 breached standards of good taste and decency. In particular, he objected to a reference to "drinking and shagging" made by one of the participants. Summary An advertisement for a light truck contained language which had been the subject of complaints to the Advertising Standards Complaints Board (ASCB). The Board’s decision on those complaints was reported in a news item on TV3’s 3 News on 23 March between 6. 00–7. 00pm. Extracts from the advertisement, including the offending language, was included in the item. Mr Shierlaw complained to TV3 Network Services Ltd that by screening the advertisement before 8. 30pm, as required by the ASCB, TV3 had failed to comply with standard G5 of the Television Code of Broadcasting Practice, which requires broadcasters to observe the principles of the law. Summary A documentary about the naturist movement in New Zealand, entitled Inside New Zealand: Nude Zealand, was broadcast on TV3 on 16 June 1999, commencing at 8. 30 pm. It contained footage of naked men and women, including breasts and male genitalia. Kristian Harang complained to TV3 Network Services Limited, the broadcaster, that the broadcast portrayed nudity as normal, whereas very few people in New Zealand were nudists and many would object to nudity being screened in their homes. The numerous scenes of naked men and women, and male genitals, in family viewing time would have a detrimental effect on children and young people, he wrote. TV3 responded that the documentary was preceded by a written and verbal warning, and screened in AO time. The programme’s depiction of nudity was innocent and non-sexual, it wrote, and portrayed the naturists’ bodies matter-of-factly....

Summary Allegations that Timberlands West Coast Ltd had lobbied the government to ensure that it could continue to harvest native forests were put to the company’s Chief Executive in an item on 20/20 titled "Unsustainable PR? " broadcast on 22 August 1999, beginning at 7. 30pm. Mr D L Hilliard, the Chief Executive of Timberlands, and Mr Stephen Sheaf each complained to TV3 Network Services Ltd that the broadcast lacked balance, was biased and unfair, and was intended to mislead viewers. Mr Hilliard, who was interviewed for the programme, also said that he had been misled as to its intention, and had consequently been treated unfairly. In its response, TV3 emphasised that the focus of the story had been Timberlands’ lobbying of the government, and noted that documents it had received indicated there was ample evidence of its having done so....
