The Authority has not upheld an accuracy complaint about a 1News segment that reported, ‘Many scientists are concerned the US Health Secretary's decision to pull funding for international vaccine development may increase hesitancy and also mean future pandemics are harder to stop.’ The complainant alleged the broadcast was inaccurate and materially misleading because it did not specify that US Health Secretary Robert F Kennedy Jr’s decision ‘was specifically about mRNA vaccines’ and  background footage of protesters was irrelevant. While broadcasts can be misleading by omission, the Authority found the item in question was not materially misleading. The brief report centred on the scientific community’s response to Kennedy’s decision and clearly identified that Kennedy’s decision did not impact all vaccines. In this context, further detail about the type of vaccines affected was not material to viewers’ understanding of the broadcast. The audience were also unlikely to be misled by the footage of protesters.

The Authority has not upheld two complaints about a broadcast of The Panel which briefly discussed public perception of the recognition of a Palestinian state and the panellists’ views on whether Aotearoa New Zealand should sanction Israel. The complaints were made under several standards and included claims the broadcast was unbalanced for not including comment from Palestinians ‘or directly affected individuals’, and treated Palestinians unfairly. Additionally, a panellist’s comment was said to be inaccurate and misleading, and to discriminate against and denigrate Palestinians. Under the balance standard, the Authority found alternative perspectives were provided by the other panellist. In addition, the broadcast: was clearly signalled as approaching the topics canvassed from the panellists’ perspectives; was narrowly focussed on certain aspects of the much larger, complex Israel-Palestine conflict; and listeners were likely to be aware of significant viewpoints given the issues had been frequently covered in a range of media. The Authority also found the panellist’s statement was comment or opinion to which the accuracy standard does not apply and did not reach the high threshold required to breach the discrimination and denigration standard. The fairness standard did not apply.

The Authority has not upheld a complaint about a 1News item reporting a leaked recording showed National MPs were ‘keen to pinch’ a Labour Party policy to improve financial conditions for retirement village residents ahead of the next general election. The complaint was that the item was unbalanced as neither the Retirement Villages Association (RVA) nor the sector were approached for comment regarding claims made in the item. The Authority found the focus of the 1News item was clearly political, highlighting the Government’s desire to address residents’ concerns before the next election, rather than claiming to be a balanced discussion of how retirement villages operate or the merits of Labour’s policy. In this context, the audience would not have expected a countering viewpoint to be presented from RVA or the sector.

The Authority has upheld a complaint that an episode of The Key of David, which discussed biblical prophecies and recent events as indicating Germans would start World War III, discriminated against and denigrated German people. Noting the repeated descriptions of Germans as ‘war-making’, the strong language (eg ‘hideous beast power from the underground’) and the descriptions of past and anticipated violence, the Authority found the cumulative effect of the comments, in the context, conveyed the high level of condemnation necessary to encourage discrimination or denigration against German people. It also found the comments were capable of embedding negative stereotypes of German people as inherently ‘war-making’ and violent. While acknowledging the standard is not intended to prevent the broadcast of ‘a genuine expression of serious comment, analysis or opinion’, the Authority found the nature of the comments exceeded these boundaries. The Authority did not make any order on the basis: publication is sufficient to publicly notify the breach and to provide guidance to broadcasters; and Sky Free has accepted the decision and taken reasonable action in response.

The Authority has not upheld a complaint about comments, during an interview on The Huddle, distinguishing alcohol from tobacco in relation to the need for cancer warning labels. The Authority found the comments amounted to opinion to which the accuracy standard does not apply and, in the context, the audience was unlikely to be misled. The Authority identified no harm sufficient to justify its intervention.

The Authority has not upheld a complaint that two interviews on Morning Report, which explored the propriety of funding for a campaign to encourage Māori to register on the Māori electoral roll, breached the balance and accuracy standards. The complainant said the interviews with Merepeka Raukawa-Tait, Chair of the Whānau Ora Commissioning Agency (WOCA) which funded the campaign, and with Hon Shane Jones, who was asked to comment on the issue, displayed ‘anti-Māori bias’. Noting the broadcast incorrectly stated WOCA was a government agency, the complainant also said listeners would be left with an impression there was corruption taking place based on a false assumption. The Authority found the balance standard was not breached as significant perspectives about the advertising campaign were presented in the broadcast and in other media within the period of current interest. While WOCA was inaccurately described as a ‘government agency’, the Authority found the error was not materially inaccurate or misleading in the context, noting WOCA administers taxpayer funds, the broadcast did not assert there was impropriety, and Raukawa-Tait responded to the questions and clarified the basis for funding the campaign.

The Authority has not upheld a complaint about a segment of Gagaifo O Faiva that reported a Supreme Court of Samoa decision which convicted 11 men in relation to a 2023 kidnapping incident in Lefagaoali’i village, Samoa. The complaint alleged the broadcast discriminated against, denigrated, and was unfair to the 11 men sentenced. The Authority acknowledged the broadcast contributed to the distress felt by the complainant and the men’s families. However, having regard to factors including audience and cultural expectations of the presenter, the high public profile of the kidnapping, and public interest in the broadcast subject matter, the Authority found criticism of the 11 convicted was not unfair and any harm caused was not at a level to justify the Authority’s intervention. The discrimination and denigration standard did not apply, since the relevant comments were aimed at individuals as opposed to a protected section of the community.

The Authority has not upheld a complaint about a 1News item on rising gang membership, which featured archival footage of gang members. The complainant said the broadcast breached the promotion of illegal or antisocial behaviour, balance and accuracy standards on the basis the footage promoted gang activity/membership and misrepresented the current situation where gang patches and insignia are banned in public. In the context of the item, the Authority did not consider the likely impact of the visual content was to encourage illegal or antisocial behaviour. It also found the content was unlikely to mislead reasonable viewers regarding current gang activity. The balance standard did not apply.

The Authority has upheld an accuracy complaint about a statement, ‘Public submissions for Phase Two of the Inquiry closes at midnight tonight’, in a 1News item reporting on the deadline for submissions to the Royal Commission of Inquiry into COVID-19 Lessons Learned. The Authority found the statement was materially inaccurate as the correct deadline was the following night and, in the context of the broadcast, this was a material point of fact. The COVID-19 Inquiry’s communications regarding the deadline for public submissions could have been clearer, but TVNZ did not make reasonable efforts to ensure accuracy. It relied on information from official press releases and communications by the Inquiry but did not seek clarification of the ambiguous deadline from a relevant person/organisation. If there was a breach of the corrections limb of the accuracy standard, any potential harm arising from that breach did not justify the Authority’s intervention, as any correction would have occurred after the deadline for public submissions closed.

The Authority has not upheld a complaint that an episode of Motorway Patrol breached the privacy standard. A short segment of the programme focused on a Senior Constable attending a crash on an Auckland motorway. It featured footage of the complainant as a ‘Good Samaritan’ who had stopped to check on the person in the crashed vehicle. The Authority acknowledged the impact of the broadcast on the complainant, who said they were not informed the filming was for broadcast purposes and were not asked for consent. However, applying the relevant guidelines under the privacy standard, the Authority found the broadcast did not disclose information attracting a reasonable expectation of privacy and would not be highly offensive to an objective reasonable person. The complainant was presented positively, displayed no obvious vulnerability and was not shown doing or saying anything an objective reasonable person would find humiliating or that would impact on their reputation.
