An episode of the British police drama series Happy Valley depicted the murder of a police officer by one of the main characters. The Authority did not uphold the complaint that the incident and aftermath constituted ‘over the top’ graphic violence. The visual depiction of the violence was not gratuitous and was mostly implied or occurred off-screen. The level of violence was not unacceptable or unexpected in an AO-rated police drama series, and was justified by the narrative context.

A ONE News bulletin reported on recent Islamic State activity and showed footage of identified supporters of ISIS and its training camps. The Authority did not uphold the complaint that this promoted, encouraged and glamorised terrorism. The news bulletin carried high public interest and was a straightforward report of recent terrorist activity that in no way condoned or glorified this behaviour.

ONE News reported that Cadbury chocolate bars were set to ‘shrink by 10 percent’, from 220 grams to 200 grams. The Authority declined to determine the complaint that the item was inaccurate because it was wrong to use the word ‘shrink’ to refer to a weight measurement and because the difference in grams was 9.1 percent, not 10 percent. The Authority found the complaint to be trivial as the complainant did not outline why the difference was material or why it would have impacted viewers’ understanding of the item as a whole.

Seven Sharp featured a brief segment about a Christchurch couple who had been recorded by members of the public having sex after hours at their workplace. The segment was presented as a humorous ‘lessons learned’ skit, featuring comments such as, ‘apparently you can see through glass’, and still photos of the incident were shown. The Authority did not uphold a complaint that the broadcast breached the couple’s privacy as the information was already in the public domain at the time of broadcast.

An item on Morning Report discussed Mark Lundy’s retrial for the murder of his wife and daughter. The Authority did not uphold a complaint that the item incorrectly inferred that Mr Lundy had actively been seeking increased life insurance on the day the murders occurred, and that this was unfair. The item was a straightforward report of the latest evidence given at trial and the item as a whole clarified the meaning of its opening statements.

A 3 News item about Andrew Little’s ‘state of the nation’ address, in which he promised that under the Labour Party, New Zealand would have the lowest unemployment rate in the OECD, featured an exchange between the reporter and Mr Little about unemployment rates. The Authority did not uphold the complaint that the item was misleading and unfair to Mr Little in giving the impression he did not know New Zealand’s current unemployment rate when in fact he did. It was clear that the figure Mr Little was unable to quote was the current lowest OECD unemployment rate and the item did not unfairly distort his views.

An episode of Water Patrol, a reality TV series following the work of the Maritime Police, showed footage of the complainant, PG, in his boat in the Marlborough Sounds. The police vessel approached him from behind and asked him to stop his motor. The complainant was caught off-guard, apparently not wearing any pants. As he stood up to engage with the police, the fact he was wrapping a towel around his waist was highlighted and the police officer turned to the camera and commented, with a smile on his face, ‘very unusual’. The Authority upheld a complaint that the broadcast breached PG’s privacy because in the unique circumstances of this particular case: the filming amounted to an intentional intrusion, in the nature of prying, with the complainant’s interest in seclusion; the intrusion was highly offensive; and it was not justified by any overriding public interest factors.

A ONE News bulletin included an item on politicians’ attendance at the Big Gay Out festival. The newsreader said, ‘The community makes up to 10 percent of New Zealand’s population and MPs were keen to show their support’. The Authority did not uphold the complaint that this statement and in particular the figure of 10 percent was inaccurate and misleading. It was expressed as an approximate figure only. There is no data available showing the exact size of the Lesbian, Gay, Bi-sexual and Transgender (LBGT) community against which to assess the accuracy of the statement.

A 3 News update, broadcast during the PGR-rated movie Night at the Museum 2, featured security footage of a man who walked into a petrol station with a metal rod lodged in his head. The Authority did not uphold a complaint that the update screened graphic and disturbing violent footage, without a warning, which would have upset children. This was a newsworthy story and the footage was relatively inexplicit. It was reasonable to expect that child viewers would have been supervised by adults, given the movie was rated PGR, and children were unlikely to be unduly alarmed or disturbed in this context.

A segment of Mediawatch canvassed TVNZ’s (as well as several other media outlets’) coverage of the latest Intergovernmental Panel on Climate Change report, in particular Breakfast’s interview with Bryan Leyland, an engineer who speaks and writes publicly on his scepticism about global warming. The Authority did not uphold a complaint from Mr Leyland that the broadcast discussed his interview in a ‘biased and derogatory’ way and amounted to a personal attack. In the context of a programme comprising robust media commentary and critique, the references to Mr Leyland were not unfair and related to his professional capacity rather than criticising him personally. It was not required in the interests of fairness to inform him of the programme beforehand or invite his comment.
